ORDINANCE 2000-05
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
SEMINOLE COUNTY, FLORIDA, CHANGING THE ZONING
MAP DESIGNATION OF A CERTAIN PARCEL KNOWN AS
THE "LAMOUREUX" PROPERTY AND MORE
PARTICULARLY DESCRIBED BELOW FROM SEMINOLE
COUNTY A-I "AGRICULTURE" TO CITY OF WINTER
SPRINGS C-l "NEIGHBORHOOD COMMERCIAL";
-PURSUANT TO 166.041 FLORIDA STATUTES; PROVIDING
FOR SEVERABILITY; CONFLICTS AND AN EFFECTIVE
DATE.
WHEREAS, Mr. Robert G. Lamoureux, the owner of the following described
property, had petitioned the City of Winter Springs to be annexed into the City and said
property was annexed into the City on October 25, 1999.
WHEREAS, the City COlmnission expressed its desire that the S.R. 434 Corridor
"New Development" Overlay Zoning District be extended to include the Lamoureux
property and Mr. Robert Lamoureux has agreed to have the S.R. 434 Corridor "New
Development" Overlay Zoning District include his property.
WHEREAS, the Planning & Zoning Board at its February 16, 2000 meeting
recommended that the City Commission approve the request for rezoning, by Mr.
Robert Lamoureux, of the 2.5 acre parcel [rom (County) zoning designation A-I
"Agriculture" to (City) zoning dcsignation C-l "Neighborhood Commercial" with the
condition that the property owner sign a statement that is "recordable" that may be filedd
with the City Clerk to the effect that he fully recognizes and agrees to the S.R. 434
Conidor New Development Overlay Zoning District applying to his property.
WHEREAS, The property owner, Mr. Robert Lamoureux, was present at the
February 16, 2000 meeting of the Planning & Zoning Board and agreed with the
recommendation of the Planning & Zoning Board that the City Commission approve the
request fOf rezoning, by Mr. Robert Lamoureux, of the 2.5 acre parcel from (County)
zoning designation A-I "Agriculture" to (City) zoning designation C-l "Neighborhood
Commercial" with the condition that the property owner sign a statement that is
"recordable" that may be filed with the City Clerk to the effect that he fully recognizes
and agrees to the S.R. 434 Corridor New Development Overlay Zoning District
applying to his property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS
FOLLOWS:
Section 1- Recitals:
The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2 - Purpose and Intent: It is hereby declared to be the purpose and intent of
this Ordinance to approve the request for rezoning, by Mr. Robert Lamoureux, of the
2.5 acre parcel from (County) zoning designation A-I "Agriculture" to (City) zoning
designation C-I "Neighborhood Commercial" with the condition that the property
owner sign a statement that is "recordable" that may be filed with the City Clerk to the
effect that he fully recognizes and agrees to the S.R. 434 Corridor New Development
Overlay Zoning District applying to his property; said property being the:
EAST ONE-HALF (1/2) OF WEST ONE-HALF
(1/2) OF NORTHWEST ONE-FOURTH
(1/4) OF NORTHEAST ONE-FOURTH
(1/4) OF SOUTHEAST ONE-FOURTH
(1/4), SECTION.4, TOWNSHIP 21 SOUTH,
RANGE 31 EAST, SUBJECT TO EASEMENT
FOR STATE ROAD 419 OVER SOUTH 30 FEET
THEREOF.
Section 3 - Repeal of Prior Inconsistent Ordinances and Resolutions:
All prior inconsistent ordinances and resolutions adopted by the City Commission, or
parts of ordinances and resolutions in conflict herewith, are hereby repealed to the
extent of the conflict.
Section 4 - Severability:
If any section, subsection sentence, clause, phrase,
word or provision of this ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, whether for substantive, procedural, or any other
reason, such portion shall be deemed a separate, distinct and independent provision, and
such holding shall not affect the validity of the remaining portions of this ordinance.
Section 5 - Effective Date: This Ordinance shall take effect at such time
Ordinance Number 756 becomes effective. If Ordinance Number 756 does
not become effective, this Ordinance shall hereby be declared null and void.

NOTICE IS HEREBY GIVEN THAT THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS WILL HOLD A SECOND READING AND PUBLIC HEARING ON
PROPOSED ORDINANCE 756 TO CHANGE THE COUNTY FUTURE LAND USE
DESIGNATION FROM "SUBURBAN ESTATES" (l DWELLING UNIT PER ACRE) TO
TilE CITY FUTURE LAND USE MAP DESIGNATION "COMMERCIAC' ON A 2.5
ACRE PARCEL OF LAND LOCATED EAST OF THE BELTWAY ("THE GREE-
NEW/\Y" S.R. 417), ON THE NORTH SIDE OF STATE ROAD 434.

A PUBLIC HEARING ON THE PROPOSED CHANGE OF FUTURE LAND USE
WILL BE HELD ON MARCH 13, 2000 AT 6:30 P.M. AT THE WINTER SPRINGS
CITY HALL.
THIS PUBLIC HEARING WILL TAKE PLACE AT THE CITY COMMISSION
CHAMBERS IN CITY HALL AT 1126 EAST STATE ROAD 434, WINTER SPRINGS,
FLORIDA. INTERESTED PERSONS MAY ATTEND AND BE HEARD.
