ORDINANCE 2000-04
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
SEMINOLE COUNTY, FLORIDA, REVISING SEC. 20-447 TO
EXPAND THE THE S.R. 434 CORRIDOR NEW
DEVELOPMENT OVERLAY ZONING DISTRICT TO
INCLUDE THE LAMOUREUX PROPERTY; PURSUANT TO
166.041 FLORIDA STA TUTES; PROVIDING FOR
SEVERABILITY; CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, Mr. Robert G. Lamoureux, the owner of the following described
property, had petitioned the City of Winter Springs to be annexed into the City and
said property was annexed into the City on October 25, 1999.
WHEREAS, the City Commission expressed its desire that the S.R. 434
Corridor "New Development" Overlay Zoning District be extended to include the
Lamoureux property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS
FOLLOWS:
Section 1- Recitals:
The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2 - Purpose and Intent:
It is hereby declared to be the purpose and
intent of this Ordinance to expand the S.R. 434 Corridor New Development Area
Overlay Zoning District to include the Lamoureux property.
That the City of Winter Springs revises Sec. 20-447 to extend the S.R. 434 Corridor
New Development Overlay Zoning District to include the following described real
property: _
EAST ONE-HALF (1/2) OF WEST ONE-HALF
(1/2) OF NORTHWEST ONE-FOURTH
(1/4) OF NORTHEAST ONE-FOURTH
(1/4) OF SOUTHEAST ONE-FOURTH
(1/4), SECTION 4, TOWNSHIP 21 SOUTH
RANGE 31 EAST, SUBJECT TO EASEMENT
FOR STATE ROAD 419 OVER SOUTH 30 FEET
THEREOF.
Section 3 - Repeal of Prior Inconsistent Ordinances and Resolutions: All
prior inconsistent ordinances and resolutions adopted by the City Commission, or
parts of ordinances and resolutions in conflict herewith, are hereby repealed to the
extent of the conflict.
Section 4 - Severability:
If any section, subsection sentence, clause, phrase,
word or provision of this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, whether for substantive, procedural, or any
other reason, such portion shall be deemed a separate, distinct and independent
provision, and such holding shall not affect the validity of the remaining portions of
this ordinance.
Section 5 - Effective Date: This Ordinance shall take effect at such time
Ordinance Number 756 and Ordinance Number 2000-05 become effective.
If Ordinance Number 756 and Ordinance Number 2000-05 do not become
effective, this Ordinance shall hereby be declared null and void.

LAMOUREUX PROPERTY
NOTICE IS HEREBY GIVEN THAT THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS WILL HOLD A SECOND READING ON PROPOSED ORDI-
NANCE 2000-4 TO EXPAND THE' S.R. 434 CORRIDOR "NEW DEVELOPMENT"
OVERLAY ZONING DISTRICT TO INCLUDE THE 2.5 ACRE PARCEL LAM-
OUREUX PROPERTY LOCATED EAST OF THE BELTWAY ("THE GREENEWAY
S.R. 417), ON THE NORTH SIDE Of STATE ROAD 434.
A PUBLIC HEARING ON THE PROPOSED EXPANSION OF THE S.R. 434 CORRI-
DOR NEW DEVELOPMENT OVERLAY ZONING DISTRICT WILL BE HELD ON
MARCH 13, 2000 AT 6:30 P.M-. AT THE WINTER SPRINGS CITY HALL.
THIS PUBLIC HEARING WILL TAKE PLACE AT THE CITY COMMISSION
CHAMBERS IN CITY HALL AT 1126 EAST STATE ROAD 434, WINTER SPRINGS,
FLORIDA. INTERESTED PERSONS MAY ATTEND AND BE HEARD.
