HomeMy WebLinkAboutResolution 645 Wastewater Transmission Authority RESOLUTION NO. 645 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, A MEMBER OF THE SOUTH SEMINOLE AND NORTH ORANGE COUNTY WASTEWATER TRANSMISSION AUTHORITY SUPPORTING THE AUTHORITY'S RESOLUTION NO. 90-1, DATED MAY 24, 1990; CONFLICTS AND EFFECTIVE DATE. WHEREAS the City of Winter Springs, Florida, a member of the South Seminole and North Orange County Wastewater Transmission Authority is opposed to the induction of contaminated groundwater discharge from City Chemical Facility into the Authority's system for transmission to Iron Bridge; and WHEREAS, the South Seminole and North Orange County Wastewater Transmission Authority has adopted Resolution No. 90-1, dated May 24, 1990; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I: The City has the concern of possible damage to facilities and objects to the potential connections of the Superfund Cleanup facility to the collection system of the Authority. SECTION II: The City has concern that there is a potential threat to the health, safety and welfare to employees of the municipalities and Authority. SECTION III: The City of Winter Springs supports Resolution 90-1 as adopted by the South Seminole and North Orange County Wastewater Transmission Authority. SECTION IV: This Resolution shall remain in force and effect until supplemented, amended, repealed or otherwise altered. SECTION V: All Resolutions or parts of Resolutions in conflict with this Resolution are hereby repealed. SECTION VI: This Resolution shall take immediate effect upon its passage and approval. Norton CITY CLERK RESOLUTION NO. 90-1 A RESOLUTION OF SOUTH SEMINOLE AND NORTH ORANGE COUNTY WASTEWATER TRANSMISSION AUTHORITY EXPRESSING OPPOSITION TO THE INDUCTION OF CONTAMINATED GROUNDWATER DISCHARGE FROM CITY CHEMICAL FACILITY INTO THE AUTHORITY SYSTEM FOR TRANSMISSION TO IRON BRIDGE; PROVIDING FOR PUBLICATION AND EFFECTIVE DATE. WHEREAS, agencies of the County, State, and Federal governments are recommending the cleanup of City Chemical groundwater contamination through the system of the Authority and its entities; and WHEREAS, the source of contaminated waste is located at or near 3920 Forsyth Road, Orlando, Florida; and WHEREAS, the contaminated waste product will enter the Authority's system at the Villa Cordova pump station; and WHEREAS, the contaminated waste product will exit the Authority's transmission system at the McCulloch and Dean Road tie-in to the City of Orlando system; and WHEREAS, the contaminated waste product will travel over five (5) miles within the Authority's system over a period of ten (10) to eighteen (18) years; and WHEREAS, the health of entity maintenance personnel may be impaired by the waste product being transmitted as they service wet wells through which the waste product will pass and inundate the sediment located therein; and WHEREAS, lines, lining material, pumps, rubber seals, valve seats, fixtures, and facilities within the system of the Authority and its entities may suffer permanent damage from contact with the contaminated waste product. I NOW THEREFORE~ BE IT RESOLVED BY THE BOARD QIo' DIRECTORS OF SOUTH SEMINOLE AND NORTH ORANGE COUNTY WASTEWATER TRANSMISSION AUTHORITY AS FOLLOWS: o B J E C T ION SECTION I - The Authority objects to the involuntary induction of contaminated waste products into its systems and the systems of its entities. CON C ERN S SECTION II The Authority identifies areas of long-term concern as follows: a. The exiting of contaminated fluids from the Authority's transmission lines into the surrounding environment in the event of a transmission line fracture. b. The exposure of Authority and entity personnel to carcinogenic agents within sand sediment located in the wet wells of the system over an indeterminate period of time. c. Damage to the transmission system and its facilities. d. Potential exposure to fines and other sanctions from County, State, and Federal agencies responsible for the protection of the environment by reason of the involuntary transmission of contaminated waste product through the system of the Authority and its entities. e. Potential exposure to fines and sanctions from County, State, and Federal agencies responsible for the protection of the environment by reason of the discharge of contaminated waste products into the environment at the terminus of transmission, the Iron Bridge Plant, in that the Authority and its entities are intermediate transmission facilities. -2- I N D E M N I F I CAT ION SECTION III. - The Authority and its entities including, but not limited to, the City of Winter Park and Seminole County, seek indemnification from C~unty, State, and Federal agencies responsible for the planning, design, and implementation of the City Chemical Superfund Waste Cleanup operation which includes the Authority and its entities as intermediate transmitters of contaminated waste products from the City Chemical point of origin. H 0 L D H ARM L E S S SECTION IV. - The Authority and its entities including, but not limited to, the City of Winter Park and Seminole County, seek to be held harmless of responsibility for damage to property or injury to persons by County, State, and Federal agencies responsible for the planning, design, and implementation of the City Chemical Superfund Waste Cleanup operation which includes the Authority and its entities as intermediate transmitters of contaminated waste products from the City Chemical point of origin. D I S T RIB UTI 0 N SECTION V. That this Resolution be published and distributed as follows: a. U. S. Environmental Protection Agency. b. Florida Department of Environmental Regulation. c. City of Orlando, Florida. d. Orange County, Florida. e. The Orange County Legislative Delegation. f. The Seminole County Legislative Delegation. g. Each of the entities within the South Seminole and North Orange Wastewater Transmission Authority. h. Such other persons and entities as shall from time to time seek a copy of this Resolution pursuant to Chapter 119, Florida Statutes, 1989. E F F E C T I V E D ATE SECTION VI. This Resolution shall be become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 24th day of May, A.D. 1990.
