RESOLUTION NO. 630
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
ADOPTING CERTAIN RULES AND PROCEDURES FOR THE AWARD
OF DESIGN BUILD CONTRACTS; SEVERABILITY, CONFLICTS
AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs,
Florida, is desirous of utilizing the design-build concept for the construc-
tion of certain public Capital Improvements, and
WHEREAS, Chapter 89-l58 Laws of Florida require that each state
agency adopt rules for the award of design-build contracts.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I: That the City Commission hereby adopts the "Rules
for Award of Design-Build Contracts", attached, hereto marked as Appendix A
and made a part hereto by reference. The purpose is to bring current the
method by which the City awards design-build contracts into accordance with
state law.
SECTION II: That the adopted Rule for Award of Design-build
Contracts shall remain in full force and effect until revised by subsequent
resolutions of the City Commission of Winter Springs, Florida.
SECTION III: This Resolution shal1 remain in force and effect
until supplemented, amended, repealed or otherwise altered.
SECTION IV: All resolutions or parts of resolutions in conflict
with this Resolution are hereby repealed.
SECTION V: This Resolution shall take immediate effect upon
its passage and adoption.

RULES FOR AWARD OF DESIGN-BUILD CONTRACTS
Following are standards and procedures for the award of design build
contracts.
SELECTION OF DESIGN CRITERIA PROFESSIONAL
1. The design criteria package for a design-build project shall
be prepared and sealed by a design criteria professional employed
or retained by the City and selected in accordance with the Con-
sultant's Competitive Negotiation Act (CCNA). The design criteria
professional shall be utilized throughout the project for consul-
tation for the evaluation of the responses on bids submitted by
the design-build firm, the supervision or approval by the City
of the detailed working drawings of the project, and for eval-
uation of the compliance of the project construction with the
design package.
2. The design-build firm shall be selected in the following manner:
a. The City's standard notice to Professional Consultants
shall be published in the local newspaper expressing
the City's desire to obtain the services of a "design-
build firm" for a specific project by a bid, a response
to the City's request for a proposal, or to obtain the
services through the Competitive Negotiation Act and
negotiate a design-build contract.
b. For projects utilizing the negotiated design-build concept
the staff shall review and grade all proposals/brochures
utilizing the standard evaluation form. The top seven
shall be interviewed by the staff, utilizing the same
form, with the resulting top three design-build firms
being scheduled and interviewed by the City Commission.
The Commission will grade and rank the three. They
will then begin negotiations with the number one
ranked firm utilizing the design criteria package and
all other applicable cost, technical and design data.
c. For projects "bid" utilizing the design criteria package
the lowest bid received from a qualified design-build
firm, meeting all requirements and specifications of
the design criteria package (cost, technical and design)
shall be awarded the project. However, the City reserves
the right to reject any and all bids.
3. These rules may be amended as required.

Instruction to Graders:
The grade you give to each of the above seven categories is subjective. Some may
think a large firm is ideal, others a small or medium size firm, etc. Grade each
category from I to 10 with lO as a maximum or most desirable and I as the least
desirable grade. Total the grades and place it below.
