RESOLUTION NO. 585
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
SUPPORTING AND AUTHORIZING AMENDMENT OF SECTION 4 OF
CHAPTER 78-617, LAWS OF FLORIDA, AMENDING THE QUORUM
REQUIREMENT; PROVIDING FOR CONFLICTS, SEVERABILITY
AND EFFECTIVE DATE.
WHEREAS, the SOUTH SEMINOLE AND NORTH ORANGE COUNTY WASTEWATER
TRANSMISSION AUTHORITY was created June 23, 1978; and
WHEREAS, the AUTHORITY was legislatively established by Chapter
78-617, Laws of Florida; and
WHEREAS, Section 4, Subsection 8, Chapter 78-617, Laws of
Florida, now requires four members to constitute a quorum; and
WHEREAS, the AUTHORITY has concluded that the best interests of the
citizens within the AUTHORITY area will be served if Section 4, Subsection 8, of
Chapter 78-617, Laws of Florida, is amended so that a quorum for voting on any
matter before the Board shall consist of three (3) votes rather than four (4)
votes; and
WHEREAS, such amendment is suggested by the entities within the
AUTHORITY considering the actions of the Board since the creation of the
AUTHORITY in 1978.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I. Section 4, Subsection 8, of Chapter 78-617, Laws of
Florida, should be amended.
SECTION II. The present Section 4 reading as follows:
Section 4. Governing board.
(8) Quorum. A quorum shall be necessary for
voting on any matter before the Board and shall
consist of four members. Regardless of total
vote, no action may be taken without the votes
of at least two members. Any matter may be
reviewed at any regular or properly called
special meeting when a quorum is not present
but no vote may be taken except when a quorum
is present.
should be amended as indicated in Section III hereof.
SECTION III. Section 4, Subsection 8, of Chapter 78-617, Laws of
Florida, shall hereafter be amended to read as follows:
Section 4. Governing board.
(8) Quorum. A quorum shall be necessary for
voting on any matter before the Board and shall
consist of three members. Regardless of total
vote, no action may be taken without the
votes of at least two members. Any matter
may be reviewed at any regular or properly
called special meeting when a quorum is not
present but no vote may be taken except when
a quorum is present.
SECTION IV. That this Resolution be forwarded to the Seminole County
Legislative Delegation and the Orange County Legislative Delegation in support of
the amendment.
SECTION V. That the Executive Director of the AUTHORITY be
authorized to take such action before the Legislature of the State of Florida to
amend Section 4 (8) of Chapter 78-617, Laws of Florida, as shall be required.
SECTION VI. Conflicts.
All Resolutions or parts of Resolutions in conflict with any of the
provisions of this Resolution are hereby repealed.
SECTION VII. Severability.
If any Section or portion of a Section of this Resolution proves
to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate
or impair the validity, force, or effect of any other Section or part of this
Resolution.
SECTION VIII. Effective Date.
This Resolution shall become effective immediately upon its passage
and adoption.
