HomeMy WebLinkAboutResolution 534 Capacity Reservation Charge RESOLUTION NO. 534 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, ESTABLISHING A CAPACITY RESERVATION CHARGE: AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Winter Springs, Florida has acquired a wastewater works and fresh water distribution system: WHEREAS, the City of Winter Springs, Florida recognizes that its resources may at times be limited: WHEREAS, the City of Winter Springs, Florida has established an equitable method of allocation of its sewer capacity to both its present and future customers: WHEREAS, the City of Winter Springs, Florida finds the reservation of capacity is costly to the City due to the debt service and opportunity costs associated with holding the capa- city: and WHEREAS, the City of Winter Springs, Florida, finds it necessary to offset the cost by the imposition of a capacity reservation charge. THE CITY OF WINTER SPRINGS, FLORIDA HEREBY RESOLVES: Section 1. As established in City of Winter Springs, Florida, Ordinance No. 331, the capacity reservation charge shall be assessed at thirty-five cents ($0.35) per gallon per year. Section 2. The capacity reservation charge assessed in Section 1 shall apply to any capacity requested in or reserved by any developer agreement to which the City of Winter Springs, Florida is a party or assignee. Section 3. The capacity reservation charge shall be stated in any developer agreement negotiated pursuant to City of Winter Springs, Florida, Resolution No. 509 and in which a capacity reservation charge is required by the terms of said resolution. Section 4. This resolution shall be retroactive and prospective in effect. Section 5. This Resolution shall take effect immediately upon its passage. PASSED, this 10th day of March, 1986.
