HomeMy WebLinkAboutResolution 533 Application Fees RESOLUTION NO. 533 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, FIXING THE FEES TO BE PAID BY APPLICANTS WITH LAND DEVELOPMENT APPLICATICNS, ZONING REVIEW APPLICATIONS, REQUESTS FOR APPOVALS FOR CERTAIN OTHER ACTIVITIES, AND FOR REIMBURSEMENT OF RECORDING AND PUBLISHING EXPENSES INCURRED BY THE CITY; REPEALING RESOLUTION NO. 321; PROVIDING FOR CONFLICTS AND EFFECIVE DATE. WHEREAS, the City of Winter Springs, Florida, has found it necessary to periodically review and update its fee schedules pertaining to activities within the City; and WHEREAS, the City of Winter Springs, Florida, has determined that it needs to revise and consolidate its schedule of filing fees for applica- tions for annexation and zoning change requests, land development plan or engineering approvals, and other related permits regulating certain activities. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF WINTER SPRINGS, FLORIDA, THAT: SECTION I - Resolution No. 335 passed and adopted December 9, 1980, is hereby repealed in its entirety. SECTION II - The Official Fee Schedule for the City of Winter Springs is hereby adopted to read as follows: A. Filing fee with application to Armex property into the City: Property with legal description Up to 50 words in length $350 Up to 100 words in length$375 Each additional increment of 50 words or portion thereof +$25 Property being annexed at invitation of the City is exempted from above fees. B. Filing fee with application to Rezone property within the City to any zoning category: Residential Single-Family categories $200 plus Residential Multi-Family $5 per acre Planned Unit Development or part Mobile Home Park of acre Rural-Urban to be Commercial and Industrial categories rezoned C. Filing fee with application for Amendment to Approved PUD Master Plan: For each 100 acres or portion thereof contained in specific area (s) under review $200 Up to a maximum fee of $2000 Public hearing notice printed in newspaper + Actual cost D. Filing fee for Arbor Permit: Residential Single-Family lot $10 Residential Mullti-Family lot, Commercial or other Nonresidential Site, or Any Acreage to be subdivided (Residential or Commercial) : Each acre up to 25 acres $4 per acre Each additional 25 acres or portion thereof +$100 Reinspection Duplication of fee Removal of dead or diseased trees No fee E. Filing, for review of Preliminary Engineering Plan (PUD Final Developnent Plan) : Property up to 25 acres $750 Each additional 25 acres or portion thereof up to 100 acres +250 Maximum fee $1500 F. Filing fee for review of Final Engineering Plan: Property up to 25 acres $500 Each additional 25 acres or portion thereof up to 100 acres $200 Maximum fee $1100 G. Filing fee for review of Site Plans: Property up to 25 acres $750 Each additional 25 acres or portion thereof up to 100 acres +250 Maximum fee $1500 H. Filing fee for Extension of Approval of a Land Developrrent Plan: With no change to original plan $ 50 With changes identified by Staff $250 I. Fee for Field Inspections by City Staff during entire developnent of platted or unplatted property in any zone (payable prior to any developnent activity) : Base fee $200 Plus for each 25 acres or portion thereof +100 J. Reimbursement of Consulting Engineering Fees: For services required from the City's consulting engineers in connection with the review, inspection, or approval of any developnent, based on accounting sul:mitted to City with letter of approval (payable prior to approval of the pertinent stage of developnent): Actual Costs K. Filing fee for request for Waiver to Subdivision Requirements pursuant to Section 14-3.2: $200 L. Filing fee for Replat approval (to be paid prior to recording): Review of replat $100 Review of any changes to deed restrictions by City Attorney, based on accounting submitted to City with letter of approval: +Actual costs M. Filing fee for Lot Split approval: $200 N. Recording Documents, payable in advance: Each incidence of one or combination of documents $25 Plats + Actual costs Deed Iestrictions charged by Easements County Resolutions confirming lot splits o. Vacation of recorded access rights: Rights-of-ways $100 per acre Easements or part of acre Up to a Maximum of $1000 Publication in newspaper of Public Hearing notice for ordinance Actual Cost P. Fee for Certified Copies of City documents: $ 1 per page Q. Filing fee for Land Use Modifications: Variance $200 Conditional Use $200 Special Exception Platted single-family lot $200 Subdivisions and Commercial Developments, for each separate exception involved $200 Extension of time limit of approval granted for the above Duplication of fee R. Filing fee for approval of All Temporary Building Locations: Construction trailers, per year or portion thereof $50 Mobile Home to be occupied on single-family lot during home ronstruction, per approved time period $100 Mobile buildings to be used for commercial purposes, per approved time period $500 Extension of approval (each time) Duplication of fee S. Filing fee for review of reqrest for approval of any developrrent plan or land use matter not listed herein: Base fee None Any legal or ronsulting rosts incurred by the City + Actual Costs T. Fee for permit to Work in Public Right-of-Way: Street Cut or Jack and Bore $50 Reinspection fee +$15 Residential Driveway $10 Reinspection fee +$10 U. Filing fee for At-Home-Sale: None V. Filing fee for Solicitor's permit: $25 per person W. Filing fee for Burn permit: $25 X. Permit to locate Trailer Signs: $100 per approval * changed Res #539 SECTION III - In demonstrable cases of unnecessary hardship, an applicant may request the City Conmission to grant relief from the specified fee by submitting a written stateIrent giving particulars conceming the permit or approval requested and explaining in full how requirerrent of the fee in the particular case is inappropiate or unduly extreme, causing an unnecessary hard- ship for reasons beyond the applicants' control. SECTION IV - This resolution shall remain in force and effect until supplemented, anended, repealed, or otherwise altered. SECTION V - All resolutions or parts thereof in conflict with this resolution are hereby repealed. SECTION VI - This resolution shall take immediate effect upon its passage and approval.
