RESOLUTION NO. 511 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, PROVIDING FOR THE APPROVAL AND CONFIRMATION OF THE DECISION OF THE EQUALIZATION BOARD CONCERNING THE ASSESSMENTS PROVIDED FOR IN RESOLUTION NO. 486 HERETOFORE ADOPTED, PURSUANT TO CHAPTER 170.08 OF THE FLORIDA STATUTES; PROVIDING FOR ASSESSMENT TO PROPERTIES BENEFITTED BY THE IMPROVEMENT OF NORTH MOSS ROAD BASED ON THE LINEAL FRONT FOOTAGE OF THOSE TRACTS OR SUBDIVIDED DEVELOPMENTS ON NORTH MOSS ROAD; PRO- VIDING FOR A CREDIT TO BE GIVEN TO EACH ASSESSMENT ON COMPLETION OF THE IMPROVEMENT IN THE AMOUNT OF THE DIFFERENCE IN THE ASSESSMENT AS HEREIN APPROVED AND CONFIRMED AND THE PROPORTIONATE PART OF THE ACTUAL COST OF SAID IMPROVEMENT TO BE PAID BY SPECIAL ASSESSMENT AS FINALLY DETERMINED UPON THE COMPLETION OF SAID IMPROVEMENT; PROVIDING FOR THE APPROVAL OF THE ASSESSMENT ROLE AND ASSESSMENT PLAT; CONFLICTS AND EFFECTIVE DATE. WHEREAS, Chapter 170.08 of the Florida Statutes requires that the governing authority of a municipality meet as an Equalizing Board to hear and consider any and all complaints as to special assessments and shall adjust and equalize said assessments on the basis of justice and right, and to approve and to confirm said assessments when so equalized by resolution; and WHEREAS, Chapter 170.08 further provides that upon completion of the improvement, the municipality shall credit to each of said assessments, the difference in the assessment as originally made, approved and confirmed, and the proportionate part of the actual cost of said improvement to be paid by special assessments as finally determined upon the completion of said improvement; and, WHEREAS, the City Commission of Winter Springs sat in the capacity of an Equalization Board after proper notice pursuant to Chapter 170.07 of the Florida Statutes on the 8th day of July, 1985. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - That the assessments provided for in Resolution No. 486 heretofore adopted by the City of Winter Springs, Florida, have been reviewed and confirmed to provide for the assessment to properties benefitted by the improvement of North Moss Road based on the lineal front footage of those tracts or subdivided developments on North Moss Road. SECTION II - That the properties to be assessed as hereinabove provided shall be all tracts and subdivisions fronting on North Moss Road, extending from S.R. 434 north to S.R. 419, the right-of-way of which is more particularly described as follows: OFFICIAL RECORDS BOOK 1658 PAGE 0211 SEMINOLE CO. FL. All of that land lying 80 feet West of the following described line: Part of Lot B, Block C and Lots 12, 52, and 53, Block D, of D. R. Mitchell's Survey of the Moses E. Levy Grant, Plat Book 1, Page 5, Public Records of Seminole County, Florida, described as follows: Commence at the intersection of the East right-of-way line of Moss Road with the centerline of the Longwood-Oviedo Road as shown on the Plat of North Orlando, Plat Book 12, Pages 10 and 11, Public Records of Seminole County, Florida. thence N 06o55'33" W 532.84 feet to the point of curvature of a curve, concave Easterly, having a radius of 676.78 feet; thence run 378.53 feet along the arc, thru a central angle of 32o02'45" to the point of tangency thereof; thence N 25o07'12" E, 341.12 feet to the North right-of-way of 3rd Street as shown on said Plat of North Orlando and the Point of Beginning, said point being on a curve, concave Northerly, having a radius of 3893.50 feet; thence from a tangent bearing of N 61o35'35" W, run N 26o 43'02" E, 535.87 feet; thence N 26o06'19"E, 932 feet plus or minus to the South right-of-way of SR 419; and that part of Moss Road as platted in Plat of North Orlando, Plat Book 12, pages 10 and 11, P.R. of Seminole County, Florida. SECTION III - That said assessments are hereby approved and confirmed after the consideration and the hearing of all complaints as to said special assessments by the Equalizaiton Board. SECTION IV -That further said assessments shall be reduced by a credit to be given to each assessment in the amount of the difference in the assessment as originally made and herein confirmed and the proportionate part of the actual cost of said improvement to be paid by special assess- ments as finally determined upon the completion of said municipal improvement. SECTION V - This Resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION VI _ All Resolutions or parts of Resolutions in conflict with this Resolution are hereby repealed. SECTION VII _ This Resolution shall take immediate effect upon its passage and approval.
