MECHANICAL CODE ADOPTED; AMENDING SECTION 6-240. CODE ADOPTED. CREATING SECTION 6-241. TERMS DEFINED; CREATING SECTION 6-242. GAS INSPECTION: CREATING SECTION 6-243. FEES: AMENDING SECTIONS 6-240--6-249: PROVIDING FOR SEVERABILITY. CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs. Florida has determined that it is in the best interest of the City of Winter Springs. Florida. to update and adopt the various standard Codes relating to building. electricity. gas. housing. mechanical. plumbing and WHEREAS. the adoption of these Codes is done to facilitate proper inspection activities by the City of Winter Springs relating to construction and to maintenance of buildings within the corporate limits of said City and relating to public safety. health and general welfare. NOW. THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS AS FOLLOWS: SECTION I - That section 6-81 Standard Building Code. Standard Existing Building Code. And Standard Housing Code adopted of Article III. Building Construction Standards. is hereby deleted in its entirety and the following replaced therefor: Sec. 6-81. Standard Building Code. Standard Existing Building Code. and Standard Housing Code Adopted. There is hereby adopted by the City the Standard Building Code - 1994 Edition, in it's entirety. excluding Sect. 102.2.1. Chapter 11. and Appendix B & E: the Standard Existing Building Code - 1988 Edition: and the Standard Housing Code -1991 Edition. as promulgated by the Southern Building Code Congress International. Inc. as the minimum standards for building and construction within the City. The provisions of the Standard Building Code shall govern all matters contained therein. except when in conflict with the provisions of this chapter or other ordinances of the City. SECTION II - That Sec. 8-82 Amendment to building code, is hereby deleted in its entirely and the following replaced THEREFORE: Sec. 6.82 Amendment to building code. (a) Section 108.1. Appointment. of the building code adopted by this chapter is hereby amended to read as follows: "There is hereby established a board to be called the board of adjustments and appeals which shall consist of five (5) members of the Winter Springs City Commission. The term of office for each of the five (5) seats which comprise the board of adjustments and appeals shall be the term of office for the commisioner who occupies that particular seat. Vacancies shall be filled for an unexpired term in the same manner in which commission seat vacancies are filled under the terms of the City Charter for the City of Winter Springs as well as the Winter Springs Code of Ordinances." (b) In addition to the requirements of the Standard Building Code Chapter 18 Sec. 1804 - Footings and Foundations, "in all masonry buildings there shall be a minimum of either two (2) one half (1/2) inch or three (3) three eighths (3/8) inch steel rods in the foundation of same." SECTION III - That Sec. 6-101 Electrical Code Adopted, of Article IV, Electricity is hereby deleted in its entirety and the following replaced therefor: Sec. 6-101. Electrical Code adopted. The City hereby adopts in its entirety that certain electrical code known as the National Electrical Code, 1996 Edition as published by the National Fire Protection Association and the Central Florida Advisory Committee Notice "K" except as otherwise provided in this article. SECTION IV - That a new section 6-103 of Article IV Electricity, is hereby created and adopted as follows: Sec. 6-103. Electrical Inspection. The building department for the City shall make all inspections, issue all permits and enforce all provisions of the National Electrical Code adopted in Sec. 6-101 within the City. SECTION V - That a new sec. 6-104 of Article IV Electricity is hereby created and adopted as follows: Sec. 6-1 04 Fees. All applications for electrical permits shall be accompanied by an appropriate electrical permit fee as set forth by the City Commission pursuant to resolutions adopted under the authority of this article which are on file in the city clerks office. SECTION VI - That Secs. 6-103---6-125 Reserved, of Article IV Electricity. is hereby deleted in its entirety and the following replaced therefor: Secs. 6-105---6-125 Reserved. SECTION VII - That Sec. 6-126. Plumbing Code adopted of A/ticle V. Plumbing is hereby deleted in its entirety and the following replaced therefor: Sec. 6-126 Plumbing code adopted. The city hereby adopts in its entirety that certain plumbing code known as the Standard Plumbing Code - 1994 Edition. excluding Appendix H, as promulgated by the Southern Building Code Congress International, Inc., except as otherwise provided in this article. SECTION VIII - That a new Sec. 6-128 of Article V Plumbing. is hereby created and adopted as folIows: Sec. 128 Plumbing inspection. The building department for the City shall make all inspections issue all permits and enforce all provisions of the Standard Plumbing Code adopted in Sec. 6-126 within the City. SECTION IX - That a new Sec. 6-129 of Article V Plumbing is hereby created and adopted as follows: Sec. 6-129 Fees. All applications for plumbing permits shall be accompanied by an appropriate plumbing permit fee as set forth by the City Commission pursuant to resolutions adopted under the authority of this article which are on file in the city clerks office. SECTION X - That Secs. 6-128 - 6-145. Reserved. of Article V Plumbing is hereby deleted in its entirety and the following replaced therefor: Secs. 6-130 - 6-145 Reserved. SECTION XI - That Article VI. Mechanical Code be amended to read; Article VI Mechanical. Sec. 6-146. Mechanical Code adopted. The City hereby adopts in its entirety that certain mechanical code known as the Standard Mechanical Code - 1994 Edition. excluding Appendix B. as promulgated by the Southern Building Code Congress International. Inc.. except as otherwise provided In this article. SECTION XII - That Sec. 6-240. Code adopted. of Article X Gas Code is hereby deleted in its entirety and the following replaced therefor: Sec. 6-240. Gas code adopted. The City hereby adopts in its entirety that certain gas code known as the Standard Gas Code - 1994 Edition. excluding Appendix B. as promulgated by the Southern Building Code Congress International. Inc. except as otherwise provided in this article. SECTION XIII - That a new Sec. 6-241 of Article X Gas Code. is hereby created and adopted as follows: Sec. 6-241. Terms Defined. The term "gas inspector" when used in the gas code adopted by Sec. 240 shall mean the City building inspector. SECTION XIV - That a new Sec. 6-242 of Article X Gas Code. is hereby created and adopted as follows: Sec. 6-242. Gas inspection. The building department shall make all inspections. issue all permits and enforce all provisions of the Standard Gas Code adopted in Sec. 6-240 within the City. SECTION XV - That a new Sec. 6-243 of Article X Gas Code. is hereby created and adopted as follows: Sec. 6-243 Fees. All applications for gas permits shall be accompanied by an appropriate gas permit fee as set foith by the City Commission pursuant to resolutions adopted under the authority of this article which are on file in the City Clerk's office. SECTION XVI- That Secs. 6-240---6-249. Reserved. of Article X Gas Code. be amended to read: Secs. 6-244---6-249. Reserved. SECTION XVII - Conflicts. All ordinances or parts of ordinances in conflict herewith being the same are hereby repealed. SECTION XVIII - Severability. If any section or portion of a section or subsection of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of section or subsection or part of this Ordinance. SECTION XIX - Effective Date. This Ordinance shall become effective immediately upon its passage and adoption. Passed and adopted this 27th day of November,1995.
