RESOLUTION NO. 501 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, ESTABLISHING A TIME AND PLACE AT WHICH THE OWNERS OF PROPERTY BENEFITTED BY THE IMPROVEMENT OF NORTH MOSS ROAD WHO ARE TO BE ASSESSED PURUSUANT TO RESOLUTION NO. 486, OR ANY OTHER PERSONS INTERESTED IN SAID ASSESSMENT, MAY APPEAR BEFORE THE CITY COMMISSION AND BE HEARD AS TO THE PROPRIETY AND ADVISABILITY OF MAKING THE MUNICIPAL IMPROVEMENTS, THE COSTS THEREOF, AND THE MANNER OF PAYMENT THEREFOR AND AS TO THE AMOUNT THEREOF TO BE ASSESSED AGAINST EACH PROPERTY SO IMPROVED PURSUANT TO CHAPTER 170.07 OF THE FLORIDA STATUTES; CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Winter Springs, Florida, has by Resolution No. 486 provided for the paving and drainage of North Moss Road, more particularly described as: All of that land lying 80 feet West of the following described line: Part of Lot B, Block C and Lots 12, 52, and 53, Block D, of D. R. Mitchell's Survey of the Moses E. Levy Grant, Plat Book 1, Page 5, Public Records of Seminole County, Florida, described as follows: Commence at the intersection of the East right-of-way line of Moss Road with the centerline of the Longwood-Oviedo Road as shown on the Plat of North Orlando, Plat Book 12, Pages 10 and 11, Public Records of Seminole County, Florida; thence N 06o55'33" W 532.84 feet to the point of curvature of a curve, concave Easterly, having a radius of 676.78 feet; thence run 378.53 feet along the arc, thru a central angle of 32002'45" to the point of tangency thereof; thence N 25o07'12" E, 341.12 feet to the North right-of-way of 3rd Street as shown on said Plat of North Orlando and the Point of Beginning, said point being on a curve, concave Northerly, having a radius of 3893.50 feet; thence from a tangent bearing of N 61o35'36" W, run N 26o43'02" E, 535.87 feet; thence N 26o06'19"E, 932 feet plus or minus to the South right-of-way of SR 419; and that part of Moss Road as platted in Plat of North Orlando, Plat Book 12, pages 10 and 11, P. R. of Seminole County, Florida. WHEREAS, said Resolution No. 486 calls for assessment of owners of property benefitted by such improvement in accordance with Chapter 170, Florida Statutes; and WHEREAS, Chapter 170.07 of the Florida Statutes requires that the governing authority of a municipality which is assessing owners of improved property to defray the costs for municipal improvements to fix a time and place by Resoltuion at which the owners of property to be assessed or any other persons interested therein may appear before said governing authority and be heard as to the propriety and advisability of making such improvements as to the costs thereof, as to the manner of payment therefor, and as to the amount thereof to be assessed against each property so improved; and OFFICIAL RECORDS BOOK 1850 PAGE 0674 SEMINOLE CO. Fl. governing authority of a municipality which is assessing for municipal WHEREAS, Chapter 170.08 of the Florida Statutes improvements to meet as an equalizing board at a time and place set herein to hear and consider any and all complaints as to such special assessments and shall adjust and equalize said assessments on a basis of justice and right. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISISON OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I. That the City Commission of the City of Winter Springs, Florida, shall meet as an Equalizing Board on the 8th day of July, 1985, at Winter Springs City Hall, 400 North Edgemon Avenue, Winter Springs, Florida, to hear and to consider any and all complaints as to the special assessments to be made for the paving and drainage improvements of North Moss Road, and shall adjust and equalize said assessments on a basis of justice and right. SECTION II. That said meeting shall be open to property owners of property to be assessed, or any other persons interested therein, and that said persons will be heard as to the propriety and advisability of making such improvements, as to the cost thereof, as to the manner of payment therefor and as to the amount thereof to be assessed against each property so improved. SECTION III. This Resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION IV. All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed. SECTION V. This Resolution shall take immediate effect upon its approval and passage. .
