RESOLUTION NO. 490
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
REAFFIRMING THE TIME NECESSARY FOR REVIEW OF DEVELOP-
MENT PLANS; PROVIDING SPECIFIC TIMES FOR COMPLETION
OF STAFF ANALYSIS AND REQUIRING FULL DOCUMENTATION
PRIOR TO RECOMMENDATION TO THE COMMISSION; CONFLICTS
AND EFFECTIVE DATE.
WHEREAS, the City Commission of Winter Springs, Florida,
requires a sufficient period of time to thoroughly review land develop-
ment plans prior to making decisions regarding approval of such plans,
and
WHEREAS, this period of time must be adequate to ensure that
the interpretation and application of the Winter Springs City Code upholds
the minimum requirements for the promotion of the public health, safety,
and general welfare of the community, that the subdividing or development
of any area is in conformity with the general goals of the presently officially
adopted Comprehensive Plan, and that due public notice is given of meetings
regarding any subdividing or development of lands within the corporate limits
of the City of winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I
That the times specified in the City Code for review
of development plans are hereby publicized and that these review periods shall
not be shortened if any documentation is missing from the plan submitted or
if any matters remain unresolved affecting the development approval.
SECTION II - Section 14-31 of the City Code pertinent to pre-
liminary development plans, Section 14-43 concerning final development plans,
and Section 14-46 regarding approval to record plats provide for periods of
time for review that are essential to permit the City to reach accurate
decisions.
SECTION III - The City Commission will take action on a request
for approval of a development only if all pertinent and necessary information
is provided to it by the Thursday preceding the Commission meeting at which a
decision is to be made.
SECTION IV - In order that the City Staff may provide all
relevant documents to the City Commission at the prescribed time, the Staff
Review that is to culminate in a recommendation to the Commission for its
consideration shall be no later than the Tuesday prior to the Commission
meeting. The Staff shall be bound to refer on to the Commission recommendations
only on development plans that are complete in all documentation by said Tuesday.
SECTION V - Whenever there are unresolved questions or incomplete
plans and documents required by Code pertaining to a development under review,
the Staff shall be empowered to defer a recommendation to the City Commission
until the plan submittal is complete. It shall be the responsibility of the
applicant to provide all needed data and furnish response to any relevant question
raised prior to the fuesday preceding the Commission meeting at which the
applicant wishes the City to render its official decision concerning the
development request.
SECTION VI - All resolutions or parts of resolutions in conflict
with this resolution are hereby repealed.
SECTION VII - This Resolution shall remain in force and effect
until supplemented, amended, repealed or otherwise altered.
SECTION VIII - This Resolution shall take immediate effect upon
its passage and approval.
