RESOLUTION NO. 456
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
FIXING THE FEE TO BE CHARGED TO DEVELOPERS TO FUND
THE COST OF MAINTENANCE AND ELECTRIC SERVICE CHARGES
INCURRED DURING THE INITIAL TWO (2) YEARS FOR STREET
LIGHTS INSTALLED IN PUBLIC RIGHTS-OF-WAY; REPEALING
RESOLUTION NO. 247; PROVIDING FOR CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, charges for electric service and maintenance for street
lights are costly; and
WHEREAS, the City incurs these expenses beginning immediately when
street lights are installed within rights-of-way dedicated to the public,
although revenues on the improved value of property adjacent to such streets
are not received for a substantial time after the installation of street lights;
and
WHEREAS, it is properly the responsibility of developers of property
along streets dedicated to the public to fund the lighting of the streets for
the initial two (2) years after installation of street lights to serve the
property they have developed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - All developers required by the City Code to install street
lights within rights-of-way dedicated to the public shall pay a one-time fee of
two hundred fifty ($250) dollars per street light to fund the cost of maintenance
of the pole and lighting fixture as well as the cost of electric service antici-
pated to be incurred during at least two (2) years after each light is illuminated.
SECTION II - The fee prescribed hereinabove shall be paid to the City
prior to acceptance of newly constructed public streets on which street lights are
to be installed, or prior to final inspection of structures adjacent to already
accepted public streets on which street lights are to be added, as pertinent.
SECTION III - The City shall deposit into the General Fund all monies paid
by developers pursuant to this Resolution.
SECTION IV - Resolution 247 is hereby repealed in its entirety.
SECTION V - This Resolution shall remain in force and effect until
supplemented, amended, repealed or otherwise altered.
SECTION VI - All Resolutions or parts of Resolutions in conflict
with this Resolution are hereby repealed.
SECTION VII - This Resolution shall take immediate effect upon its
passage and approval.
