HomeMy WebLinkAboutOrdinance 593 Adult Entertainment ORDINANCE NO. 593 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, EXTENDING THE CURRENT SIX (6) MONTH MORATORIUM ON THE APPROVAL OR ISSUANCE OF LICENSES FOR THE OPERATION OF ADULT ENTERTAINMENTS WITHIN THE CITY; FOR NINETY (90) DAYS, IDENTIFYING ADULT ENTERTAINMENT ESTABLISHMENTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, there is a continuing and increasing concern from the citizens of the City regarding the establishment and operation of adult entertainment establishments within the City; and WHEREAS, the concerns of the citizens have been repeatedly communicated to the Mayor and Commission; and WHEREAS, the approval or issuance of licenses for the operation of additional adult entertainment establishments within the City may result in the proliferation of adult entertainment establishments within the City while existing legislation is being studied, modified, amended, supplemented, and finalized by the City; and WHEREAS, the issuance of licenses and the approval of additional adult entertainment establishments in the interim will operate to the detriment of the City and its citizens; and WHEREAS, it is hereby declared to be in the best interest of the health, safety, and general welfare of the citizens of the City of Winter Springs, Florida, to abate the issuance of licenses of additional adult entertainment establishments within the City pending modification of current legislation which controls the establishment, licensing, and operation of adult entertainment establishments as defined in Article III, Adult Entertainment Establishments, Sections 10-66 and 10-86, Code of Ordinances of the City of Winter Springs, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - MORATORIUM. There is from the date of passage and adoption of this Ordinance, extending the current six (6) month moratorium for a period of ninety (90) days, a moratorium in the City of Winter Springs, Florida, on the licensing and approval of additional adult entertainment establishments within the City. For and during that period, no new adult entertainment establishments shall be considered or accepted for licensing or operation. Submittals for the licensing and operation of adult entertainment establishments presently in process shall be abated during the moratorium period. SECTION II - DEFINITION. Adult entertainment establishments shall be those adult entertainment establishments identified and defined in Sections 10-66 through 10-91 inclusive of the Code of the City of Winter Springs, Florida. SECTION III - CONFLICTS. All Ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed. SECTION IV - SEVERABILITY. Ifany Section or portion ofa Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION V - EFFECTIVE DATE. This Ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 28th day of August, 1995. CITY OF WINTER SPRINGS JOHN F.
