A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, REQUESTING THAT THE FLORIDA DEPART-
~lliNT OF TRANSPORTATION APPROVE A RAILROAD
CROSSING AT VISTAWILLA DRIVE, CITY OF WINTER
SPRINGS, FLORIDA; AUTHORIZING THE CITY MANAGER
TO TAKE ALL gDCH ACTIONS AS HE DEEMS APPROPRIATE
TO PROCESS THE REQUEST FOR THE ~.ILROAD CROSSINGS,
PROVIDING FOR CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs,
Florida, has determined the public health and safety of its
citizens necessitates a Seaboard System Railway Company railroad
crossing at Vistawilla Drive, City of Winter Springs, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~ll~ISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I. That the City Commission of Winter Springs,
Florida, requests the Florida Department of Transportation and
the Seaboard System Railway Company, approve a public crossing
at the railroad crossing at Vistawilla Drive, City of Winter
Springs, Florida.
SECTION II. That the City Manager is authorized to take
such actions as he deems appropriate to process the application
for approval of a railroad crossing as provided herein.
SECTION III.
That this Resolution shall remain in full
force and effect until supplemented, amended, repealed or other-
wise altered.
SECTION IV. All Resolutions or parts of Resolutions in
conflict with this Resolution are hereby repealed.
SECTION V. This Resolution shall take immediate effect upon
its passage and approval.

AN ORDINANCE OF THE CITY OF WINI'ER SPRINGS, FLORIDA,
AMENDING THE Cct-1PREHENSlVE PLAN IN ACCORDANCE WITH FLORIDA
STATUTES 163.3187; PROVIDING FOR THE ADDITION OF ANNEXED
PROPERTY TO THE LAND USE MAP AT HIGH DENSITY RESIDENTIAL
CLASSIFICATION; PROVIDING FOR THE ZONING CATEGORY R-3 FOR
THE PROPERTY ON THE OFFICIAL ZONING MAP; SEVERABILITY ,
CONFLICTS, AND EFFECTIVE DATE.
WHEREAS, the Ci ty of Winter Springs has annexed the property
described below, upon petition of the owners, Alejandro and Ramonita Baez:
Lot 5 west of Tuscawilla Road, Tuskawilla, D.R. Mitchell's
Survey of the Levy Grant, Plat Book 1, Page 5, Public
Records of Seminole County, Florida.
WHEREAS, the owners of the property wish to use the property in a
manner consistent with the zoning category R-3 of the City of Winter
Spr ings; and
WHEREAS, the annexed property must carry the land use
classification High Density Residential to allow for said zoning category
R-3 and
WHEREAS, The City of Winter Springs, Florida, has considered the
assignment of the High Density Residential land use classification for the
said property on the Land Use Map of the City in accordance with Florida
Statutes 163.3187 and has determined that the addition of the property to
the Land Use Map as High Density Residential is consistent with the
Comprehensive Plan of the City of Winter Springs, Florida.
NCW, THEREFORE, BE IT ORDAINED BY THE CITY CCMv:lISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to add to the Land Use Map the property described
below and to assign to it the land use classification High Density
Residential:
Lot 5 West of Tuscawilla Road, Tuskawilla, D.R. Mitchell's
Survey of the Levy Grant, Plat Book 1, Page 5, Public
Records of Seminole County, Florida.
SECTION II - The property is hereby zoned R-3 Multi-Family Dwelling
District and shall be so specified on the Official Zoning Map of the City of
Winter Springs, Florida.
SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or subsection or part of the Ordinance.
