RESOLUTION NO. 431
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
URGING GOVERNOR BOB GRAHAM, THE FLORIDA LEGISLATURE
AND THE BOARD OF COUNTY COMMISSIONERS FOR SEMINOLE
COUNTY TO MAKE THE PRESENTLY EXISTING DISTRIBUTION
FORMULA FOR THE FOUR CENTS GASOLINE TAX ENACTED BY
SEMINOLE COUNTY BOARD OF COUNTY COMMISSIONERS AS
AUTHORIZED BY THE STATE OF FLORIDA, PERMANENT DURING
THE TEN (IO) YEAR DURATION OF THE AUTHORIZED GASOLINE
TAX; SEVERABILITY; CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the State of Florida has enacted legislation which
permits individual counties to enact a separate and additional gasoline tax
which is distributed either by agreement of the County Commissioners and the
individual cities within the county, or by a distribution fornula based on
expenditures for road repair and traffic control over the previous five years;
and
WHEREAS, the Board of County Commissioners and the individual
cities of Seminole County failed to decide on a distribution formula and
consequently, the distribution formula authorized by the State of Florida
derived from previous road repair and traffic control was enacted; and
WHEREAS, the City Commission of the City of Winter Springs,
believes that the distribution formula authorized by the State of Florida provides
a fair and equitable distribution of revenues being derived from the additional
gasoline sales tax; and
WHEREAS the individual cities require some stability and assurance
that the level of receipts to be derived from the additional gasoline tax is
predictable so cities can plan long range expenditures with the knowledge that
revenues will be sufficient to defray expenses incurred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA AS FOLLOWS:
SECTION I - That the Board of County Commissioners of Seminole
County be urged to continue the existing distribution formula for the remaining
period the additional four (4) cents county gasoline tax is in effect.
SECTION II - That the Seminole County Legislative Delegation be
urged to sponsor legislation which would provide stability in the manner of
distribution of additional gasoline taxes received as a result of additional
taxes imposed by the Board of County Commissioners,
SECTION III - That a copy of this resolution be sent to
Governor Bob Graham of the State of Florida with the request that he initiate
appropriate action to ensure that individual cities are treated fairly and
equitably in the distribution of additional gasoline taxes imposed by Board
of County Commissioners.
SECTION IV - This resolution shall remain in force until
supplemented, amended, repealed or otherwise altered.
SECTION V - All resolutions or parts of resolutions in conflict
with this resolution are hereby repealed.
SECTION VI - This resolution shall take immediate effect upon
its passage and approval.
