ORDINANCE NO. 554
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING SECTION 14-52, CODE OF THE CITY OF WINTER
SPRINGS, FLORIDA AS ADOPTED BY ORDINANCE NO. 411,
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, the City Commission for the City of Winter Springs,
Florida, is desirous of assuring a continuing quality pension plan for
the employees of the City of Winter Springs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION 1. That Section 14-52 Board of Trustees, City of Winter
Springs Code as adopted by Ordinance No. 411, is hereby amended as follows:
A. There is hereby created and established a Board of Trustees
consisting of five (5) members who shall be appointed for a term of three (3)
years by resolution of the City Commission. Each Commissioner shall have one
appointment to the Board. The successors of the original appointees shall be
appointed for terms of three (3) years by resolution of the City Commission.
Vacancies in the Board shall be filled by the City Commission for the unexpired
term of such vacancy.
B. The Board of Trustees shall meet no less than quarterly to
review the performance of the pension plan and conduct such other business
as the Board deems appropriate and necessary.
C. Any member of the Board of Trustees may be removed at any time
during his term upon a majority vote of the City Commission. Any member of the
Board of Trustees who is absent from more than two (2) consecutive meetings shall
automatically forfeit his position on the Board.
D. The Board of Trustees shall administer the City's pension plans
pursuant to the provisions contained therein as adopted by the City Commission.
SECTION 2. If any section or portion of this Ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to invalidate or
impair the validity, force or effect of any other section or portion of a section
or subsection or part of this Ordinance.
SECTION 3. That all Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
SECTION 4. This Ordinance shall take effect immediately upon its
final passage and adoption.
