HomeMy WebLinkAboutOrdinance 553-A Amending Ordinance 553 ORDINANCE NO. 553-A AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AMENDING THE EFFECTIVE DATE OF ORDINANCE NO. 553; PROVIDING FOR SEVERA- BILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs adopted Ordinance No. 553 on January 10, 1994; and WHEREAS, Section 3 of that Ordinance provided that it would take effect on January 10, 1994; and WHEREAS, the effective date of plan amendments are governed by Florida Statutes l63.3l89(2)(a), Florida Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AS FOLLOWS: SECTION 1. AMENDMENT OF EFFECTIVE DATE. The effective date of Ordinance No. 553 is hereby amended to be the date upon which the State Land Planning Agency issues a final order determining the adopted amendment to be in compliance in accordance with Section 163.3184(9), Florida Statutes, or the date on which the Admini- stration Commission issues a final order determining the adopted amendment to be in compliance in accordance with Section 163.3184(10), Florida Statutes. Except as specifically amended hereby, Ordinance No. 553 remains unchanged and in full force and effect. SECTION 2. SEVERABILITY. If any section, phrase, sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and in- dependent provision and such holding shall not effect the validity of the remaining portions thereof. SECTION 3. EFFECTIVE DATE. This Ordinance shall immediately take effect upon adoption, with a quorum present and voting, by the City Commission of the City of Winter Springs, Florida this 28th day of March, 1994. WHEREAS, the City Commission of the City of Winter Springs, adopted Ordinance No. 553 on January 10, 1994; and WHEREAS, The Florida Department of Community Affairs has determined that Policy F-4 of the Traffic Circulation Element is not in compliance with Florida Statutes because it is inconsistent with Sections 163.3177 and 163.3189 F.S. NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION 1. AMEND POLICY F-4 OF THE TRAFFIC CIRCULATION ELEMENT Policy F-4 of the Traffic Circulation element is hereby amended to read: Permit no individual residential driveways onto collector or arterial roads when local roadways can be designed and developed which con- solidate trips to the collector or arterial road system. Except as specifically amended hereby, Ordinance 553 remains unchanged and in full force and effect. SECTION 2. SEVERABILITY If any section, phase, sentence or portion of the Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate distinct and independent provision and such holding shall not effect the validity of the remaining portions thereof. SECTION 3. EFFECTIVE DATE The effective date of this ordinance shall be the effective date of Ordinance 553 as amended by Ordinance 553-A.
