RESOLUTION DENYING APPLICATION OF IMARA CORPORATION
FOR FINAL P.U.D. DEVELOPMENT PLAN APPROVAL
GROUNDS: Proposed Density Is Not Suitable
WHEREAS Imara Corporation, [hereinafter, "the Developer"} has made
application to the City of Winter Springs for approval of a Final P.U.D. Development
Plan and Preliminary Subdivision Plan affecting certain real property located in the
Tuscawilla P.U.D. known as "Fairway Oaks II", hereafter referred to as "the Subject
Property"; and
WHEREAS the Developer has failed to present competent substantial evidence
that the subject real property has ever received approval from the City Council of any
specific density of dwelling units per gross residential acre; and
WHEREAS the criteria to be used by the City Council in initially establishing a
suitable density of dwelling units per gross residential acre are:
a. The compatibility with other zoning districts in the vicinity of
the Subject Property and with adopted comprehensive land
plans and policies.
b. The preservation of natural features and environmental assets
of the site.
c. The provisions for landscaped common open space providing
leisure and recreational uses for the residents.
d. The adequacy and proximity of public roads, utilities, services,
and facilities required to serve the development. And,
WHEREAS, based on the evidence presented, and in consideration of the
foregoing criteria, the City Council finds that a suitable residential density for the real
property is less than twelve dwelling units per gross residential acre;
NOW THEREFORE, be it RESOLVED that the Final P.U.D. Development Plan
application of Imara Corporation for approval of its Final P.U.D. Development Plan be
and the same hereby is DENIED.
