AN ORD I NANCE OF THE CITY OF WINTER SPR I NGS, FLOR I DA, TO
EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE
HERE I NAFTER DESCRIBED LANDS SITUATE AND BEING IN SEMINOLE
COUNTY, FLOR IDA, PURSUANT TO FLOR I DA STATUTE 171.044,
PROV I DING DIRECT IONS TO THE CITY CLERK; SEVERAB I L I TY;
CONFLICTS; AND EFFECTIVE DATE.
WHEREAS, the Seminole County School Board, acting on behalf of
Ervine J. and Martha M. Button and Crescent View Enterprises, Limited, has
petitioned the City of Wnter Springs, Florida, to annex the property
described as follows:
All of Lots 19, 20, 21, 22, 2S and a portion of Lot 24,
all located in Block "B", D.R. Mitchells Survey of the
Levy Grant on Lake Jessup as recorded in Plat Book 1, Page
5 of the Public Records of Seminole County, Florida; and
being further described by metes and bounds in attached
Appendix "A" as Parcels "A" and "C".
WHEREAS, the Charter of the City of Winter Springs provides for the
annexation of property into the corporate limits when enacted by an
Ordinance of the City, and pursuant to a petition of the landowners; and
WHEREAS, Florida Statute 171.044 of the General Laws of Florida
provides that a municipality may annex property into its corporate limits,
upon the voluntary petition of the owners, by passing and adopting a
nonemergency ordinance to annex said property; and,
WHEREAS, the City Commission of the City of Winter Springs,
F lorida, is desirous of annexing and redefining the boundaries of the
municipality to include the subject pursuant to the authority contained in
the City Charter of the City of Winter Springs, Florida, and Florida Statute
171.044, General Laws of Florida;
NOW, THEREFORE, THE CITY OF WINTER SPR I NGS, FLOR IDA, HEREBY
ORDAINS:
SECTION I - That the City of Winter Springs, Florida, does herewith
and does hereby annex and redefine the boundary 1 ines of the municipality of
the City of Winter Springs, Florida, by including that certain contiguous
land lying in Seminole County, Florida, and more particularly described as
follows:
All of Lots 19, 20, 21, 22, 2S and a portion of
Lot 24, all located in Block "B", D.R. Mitchells
Survey of the Levy Q"ant on Lake Jessup as
recorded in Plat Book 1, Page S of the Pub 1 ic
Records of Seminole County, Florida; and being
further described by metes and bounds in
attached Appendix "A" as Parcels "A" and "C".

SECTION III - That upon passage and adoption of the Ordinance, the
City Clerk is hereby directed to file a certified copy of this Ordinance
with the Clerk of the Circuit Court in and for Seminole County, Florida, and
to file a certified copy with the Department of state of the State of
Florida.
SECTION IV - That if any section or portion of section or
subsection of this Ordinance proves to be inval id, unlawful or
unconstitutional, it shall not be held to invalidate or impair the validity,
force, effect of any other section or portion of a section or subsection of
part of this Ordinance.
SECT I ON V - That all ord i nances or parts of ordi nances in conf 1 ict
herewith are hereby rePealed.
SECTION VI - That this Ordinance shall take effect sinultaneously
upon its passage and adoption.

existing Easterly right of way line of State Road #434 as shown

a curve cancave Southwesterly and having a radius of 162.25 feet;
thence Northwesterly along the arc of said curve through a central

Easterly along the arc of said curve being the Southerly right
of way line af the Lake Charm Branch, Atlantic Caast Line
Railroad as filed in the year 1917, through a central angle of

Easterly along the arc of said curve through a central angle of

South af the Lake Charm Branch, Atlantic Coastline Railroad a 100
foot wide right of way, as filed in the year 1917 in the Public
Records of Seminole County, Florida, said part being described as
follows:
From the Southeast corner of Lot 22, Block "B", run thence South
710. 29' 09" East along the South Line of aforesaid Lot 23 for 500.41 feet
to. the Southwest corner of Lot 24; thence continue South 710. 29'
09" East along the south line of Lot 24 for 235.50 feet to. the
Point of Beginning; thence North 180. 36' 26" East along a line
parallel to. the East line of Lot 22 for 503.03 feet to. a point
on the aforementioned railroad right of way line; thence South
490. 21' 38" East along said right af way line far 80.27 feet to. the
beginning af a curve cancave to. the Southwest and having a raduis
