HomeMy WebLinkAboutOrdinance 538 Chapter 19 ORDINANCE NO. 538 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, F LOR I D A , AMENDING SEC. 19-97 BILLING, PAYMENT, DELINQUENCY, SEC. 19-100 APPLICATION REQUIREMENTS AND SEC. 19-102 USER CHARGE SCHEDULE, GENERAL OF ARTICLE II, CHAPTER 19, DIV. 4 RATES, FEES AND CHARGES; PROVIDING SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the city commission of the City of Winter Springs, Florida, has determined it to be In the best interest of the safety, health, and welfare of the citizens of the City of Winter Springs to provide for the adoption of Rates, Fees and charges relating to water and wastewater and WHEREAS, it is necessary to update these Codes from time to time. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I That Sec. 19-97 Billing, payment, delinq- uency is hereby deleted in its entirety, and the following replaced therefore: Sec. 19-97. Billing, payment, delinquency. Users of the wastewater treatment and freshwater distribution system shall be billed monthly and payment shall be due upon receipt of bill. A payment not received within thirty (30) days from the date of mailing the bill shall be delinquent, and the delinquent amount shall be included in the next months billing. If the entire bill is not paid in full wi thin f i f teen (15) days f rom the date of maiIing of the second bill, service shall be discontinued. A fee of ten dollars ($10.00) shall be assessed to reinstate serVIce, and a fee of twenty-five dollars ($25.00) shall be assessed for reinstallment of a meter if removed for nonpayment or unable to lock off. A fee of twenty doll ars ($20.00) shall be assessed for each check returned for insufficient funds or closed account. Any customer who has two (2) returned checks within a six-month period will be required to make payment in cash or money order. SECTION II That Sec. 19-100 Application requirements is hereby deleted in its entirety, and the following replaced therefore: Sec. 19-100 Application requirements. (a) All applications shall be made at the business office during office hours. (b) Each applicant shall be required to provide information and pay fees at the time of application. (1) Residential users. Application shall include but not be limited to the following information: a. Name(s) of applicant; b. Address for which the service is requested and the residence of the appl icant, if different; and c. Residence telephone number of the applicant at the service address and at the residence address, if different. A deposi t fee and an application fee shall be assessed at the time of application for service. The deposit fee shall accrue interest at the rate of six (6) percent per annum. Upon completion of twenty-five (25) months of service with no delinquents during the previous twenty-four (24) months, the deposit will be refunded. The twenty- five (25) month time period will commence again upon the first turn off of service for nonpayment. A new deposit will be required to be paid by the customer upon the first time service is discontinued after the deposit has been refunded. when service is terminated, the deposit plus the interest less any outstanding fees and charges shall be refunded to the user. There will be no interest refunded on any account which has been ln service six (6) months or less. An inspection fee shall be assessed at application and for each connection when applicable; refer to miscellaneous charges, section 19-102(5)c. (2) Nonresidential users. Application shall include such information as the utility director prescribes and that is necessary for c I assi f i cation, reference, and other similar identification purposes. A deposit fee and an application fee shall be assessed at the time of application. The deposit fee shall accrue interest at the rate of six (6) percent per annum and shall be paid when service is terminated. When service is terminated, the deposit plus interest shall be refunded to the user. There will be no interest refunded on any account l.n service six (6) months or less. An inspection fee shall be assessed at application and for each connection when applicable; refer to miscellaneous charges, section 19-102(5)c. SECTION III That Sec. 19-102 User charge schedule, general is hereby deleted in its entirety, and the following replaced therefore: Sec. 19-102 User charge schedule, general. The following rates and charges shall apply to all systems unless otherwise specifically stated: (1) Monthly water service rates. (5) East system guaranteed revenue charges: The city will charge and collect guaranteed revenues from property owners, bui ders, or developers in order to defray the utility's cost for the ownership, operation, maintenance of facilities and/or capacity dedicated or otherwise committed to such property owner, builder, or developer, but not presently serving customers. The city will only reserve capacity f or such property owners, builders, or developers when and to the extent that guaranteed revenues are paid. All ordinances or parts of ordinances in conflict herewith being the same are hereby repealed. SECTION V SEVERABILITY. If any section or portion of a section or subsection of this ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of section or subsection or part of this Ordinance.
