RESOLUTION NO. 389
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, IMPOSING
A SIX MONTH'S }IDRITORIUM ON THE RECEIPT OF APPLICATIONS FOR
REVIEW OF A SITE PLAN FOR THE DEVELOPMENT OF LAND UPON WHICH
A CONVENIENCE STORE OR GAS STATION WILL BE BUILT, OR A SPECIAL
EXCEPTION FOR THE CONSTRUCTION OF SUCH CONVENIENCE STORE AND/OR
GAS STATION.
WHEREAS, the permitted uses in C-l and C-2 zoned commercial property
are under continued study by the City Commission and Staff, and
WHEREAS, the City Commission is presently considering an ordinance
that would administratively rezone certain comercially zoned property, and
WHEREAS, the City Commission is concerned over the number of
applications for convenience stores and gas stations it has been receiving
and needs additional time to formulate a policy in regard to such uses, and
WHEREAS, the City Commission feels that an emergency situation exists
which requires a short moratorium while the City formulates policy in this
regard.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, THAT
SECTION I - there shall be imposed a six month moratorium on the
receipt by the City of requests for special exceptions for applications for
review of a site plan for the construction of a gas station or convenience
store within the city limits of Winter Springs, Florida.
SECTION II - this moratorium shall be effective upon passage of this
resolution.
