HomeMy WebLinkAboutResolution 382 Drainage Easement OFFICIAL RECORDS BOOK 1393 BOOK 0926 SEMINOLE CO FL RESOLUTION NO. 382 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, VACATING, ABANDONING, AND CLOSING A DRAINAGE EASEMENT HEREINBELOW DESCRIBED; CONFLICTS, EFFECTIVE DATE. WHEREAS, in connection with the proposal to construct an outfall structure at the north shore of Lake Audubon to regulate water flow Lake Audubon drainage system, a drainage easement was executed and recorded granting the City access over the proposed site of the outfall structure, to-wit: A 30 foot wide drainage easement as recorded in Book 1278, pages 1601-1603, Official Records of Seminole County, Florida, being a portion of Tracts "F" and "G", The Highlands, Section III, described as follows: Beginning at the southwest corner of Tract "G", The Highlands Section III, as recorded in Plat Book 17, pages 48 and 49, Public Records of Seminole County, Florida, said point also being the southeast corner of Wildwood, as recorded in Plat Book 19, pages 7 through 10 inclusive, Public Records of Seminole County, Florida; run thence N 12054'04" E along the line common to the aforementioned two subdivisions a distance of 25 feet; thence S 77005' 56" E 30 ft.; thence S 12054'04" W 231.50 feet to a point on the south line of Tract "F" of said The Highlands, Section III, said point lying S 890 56'10" E 926.80 feet from the westerly line of said Tract "F"; thence run N 89056'10" W along the southerly line of said Tract "F" a distance of 30.77 feet; thence N 12054'04" E 213.33 feet to the Point of Beginning. WHEREAS, subsequent engineering and actual construction of the outfall structure prove the existing easement to be mislocated and therefore inadequate to provide the City accessibility to the outfall structure; and WHEREAS, Big Cypress Associates, Ltd., and Dayron Corporation have provided the City newly executed easements at the accurate location of the outfall structure; and WHEREAS, Dayron Corporation has executed an easement to the City from Sheoah Blvd. over Tract G of Section 3 of the Highlands to provide access for the City from a public right-of-way to the new easements at the Lake Audubon outfall structure; and WHEREAS, after due consideration, the City Commission of Winter Springs, Florida, has determined that the abandonment of the original, in- accurately located drainage easement is in the best interest of the City of Winter Springs, Florida, and the public NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - That the City of Winter Springs, Florida, hereby abandons, and vacates the drainage easement below described. SECTION II - That this resolution should remain in force until supplemented, amended, repealed or otherwise altered. SECTION III - That all resolutions or parts of resolutions in conflict with this resolution are hereby repealed.
