AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
VACATING, ABANDONING AND CLOSING THE SOUTHERN THREE (3)
FEET OF THAT NORTHERN UTILITY EASEMENT (VARYING WIDTH)
LOCATED ON THE NORTHERN PORTION OF LOT 116, GREENSPOINTE,
PLAT BOOK 29, PAGES 24-27 OF THE PUBLIC RECORDS OF
SEMINOLE COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED
AS FOLLOWS; PROVIDING FOR CONFLICTS, SEVERABILITY AND
EFFECTIVE DATE:
WHEREAS, the City Commission for the City of Winter Springs,
Florida, has determined it to be in the best interest of its citizens to
vacate the utility easement described herein;
NOW, THEREFORE, be it ordained by the City Commission of the City
of Winter Springs, Florida as follows:
SECTION I: The City hereby vacates and abandons the following
described property:
THE SOUTHERN THREE (3) FEET OF THAT NORTHERN UTILITY
EASEMENT (VARYING WIDTH) LOCATED ON THE NORTHERN
PORTION OF LOT 116, GREENSPOINTE, PLAT BOOK 29,
PAGES 24-27 OF THE PUBLIC RECORDS OF SEMINOLE COUNTY,
FLORIDA.
THE ABOVE DESCRIBED PARCEL OF LAND LIES IN SEMINOLE
COUNTY, FLORIDA.
SECTION II: That any portion of any City Ordinance in conflict
herewith shall hereby be repealed.
SECTION III: This Ordinance shall be effective upon its passage.
DONE AND ORDERED THIS 27th day of July, 1992, in
Chambers at Winter Springs, Florida.

three feet (3') of the utility easement which exists as an en-
croachment on the property located at 510 Osprey Lane in Greens-
pointe, The Highlands in Winter Springs.
Letters from each of the utility companies and the Greenspointe
Homeowners Association have already been delivered to you at your
office on Tuesday, June 2, 1992, indicatin? that they have no
opposition to vacating these three feet (3 ) of easement.

Dear Mr. Dendy:
Winter Springs Water & Sewer does not have any objection to
vacating three feet of the five foot easement on the north
portion of Lot 116 in Greenspointe as recorded in plat book 29,
pages 24-27 of the public records of Seminole County, Florida.

The water and sewer department does not have any lines
within the five foot easement but there is a 24" storm pipe in
that easement. The edge of the storm pipe comes to within 6" of
the corner of the house.
It is my understanding that the streets and storm system in
Greenspointe belongs to the homeowners. This situation needs to
be addressed with the homeowners association.
