ORDINANCE NO. 518
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
PROVIDING FOR THE ADDITION OF SUB-SECTION (C) TO
CHAPTER 12; MOTOR VEHICLES AND TRAFFIC, ARTICLE II.
ADMINISTRATION, SECTION 12-31. FAILURE TO OBEY CITATION;
CONFLICTS, SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida,
has previously deemed it in the best interest of the City of Winter Springs,
Florida to regulate the stopping, standing, and parking of motor vehicles
within the City of Winter Springs, Florida, and
WHEREAS, the City Commission of the City of Winter Springs, Florida,
has previously provided for the issuance of citations and the collection of
fines for parking violations within the City of Winter Springs, Florida, and
WHEREAS, the City Commission of the City of Winter Springs, Florida,
has deemed it in the best interest of the City of Winter Springs, Florida, to
take certain action against persons who fail to pay fines or otherwise satisfy
parking violation citations, and
WHEREAS, Florida Statutes have provided a means by which such action
may be taken against persons who fail to pay fines or otherwise satisfy park-
ing violation citations, and
WHEREAS, Florida Statutes currently provide that the clerk of the
court or traffic violations bureau of each county shall provide information
to the Department of Highway Safety and Motor Vehicles on magnetically encoded
computer tape reel or cartridge in the instances of violations of handicapped
parking statutes or local ordinances,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - That Section 12-31(c) is hereby created and added to
Chapter 12 Motor Vehicles and Traffic, Article II Administration, as follows:
SECTION 12-31(C) - The City will provide the clerk of the court with
information on any person who fails to pay the fine(s) established, or other-
wise satisfy three or more parking violation citations. The clerk of the
court shall supply this information to the Department of Highway Safety and
Motor Vehicles on a magnetically encoded computer tape reel or cartridge which
is machine readable by the installed computer system of the department, for
the purpose of marking the appropriate registration records of those so listed,
in accordance with the provisions of Florida Statutes 316.1967(6) and 320.03(8)

SECTION II - Conflicts. All ordinances or parts of ordinances in
conflict herewith being the same are hereby repealed.
SECTION III - Severability. If any section or portion of a section
or subsection of this Ordinance proves to be invalid, unlawful or uncon-
stitutional, it shall not be held to invalidate or impair the validity,
force or effect of any other section or portion of section or subsection or
part of this Ordinance.
SECTION IV - Effective Date. This Ordinance shall become effective
immediately upon its passage and adoption.
