HomeMy WebLinkAboutResolution 342 Moratorium Adult Establishments RESOLUTION NO. 342 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, EXTENDING AN EXISTING 180-DAY MORATORIUM ESTABLISHED BY RESOLUTION NO. 307 FOR AN ADDITIONAL 120 DAYS ON THE GRANTING OF SPECIAL EXCEPTIONS, VARIANCES, OR THE ISSUANCE ISSUANCE OF OCCUPATIONAL LICENSES TO ESTABLISHMENTS WHEREIN INTOXICATING BEVERAGES ARE SOLD AND CONSUMED AND TOPLESS DANCING PERFORMANCES ARE PERHITTED, OR WHERE-IN PORNOGRAPHIC MATERIALS ARE ADVERTISED AND SOLD. WHEREAS, the City of Winter Springs, Florida, is actively coordinating with officials of Seminole County to protect the health, safety, and welfare of the citizens of Seminole County and the City of Winter Springs, Florida, relative to the captioned matters; and WHEREAS, legislation is being studied and drafted which will properly control the establishment of additional areas within the City of Winter Springs, Florida, wherein intoxicating beverages are sold and consumed and topless dancing performances are permitted; and WHEREAS, it is imminently necessary that the Mayor of the City of Winter Springs, Florida, continue his investigation and coordination with Seminole County regarding the establishment and control of businesses wherein pornographic materials are advertised and sold; and WHEREAS, the extending of an existing 180-day moratorium established by Resolution No. 307 for an additional 120 days is required in order for the City of Winter Springs, Florida to adopt ordinances dealing with the aforesaid subject matter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCILOF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I. The extending of an existing 180-day moratorium established by Resolution No. 307 for an additional 120 days during which period zoning requests, special exceptions, variances, and applications for occupational licenses will be abated as follows: A. Applications for zoning, special exceptions, variances, and occupntional licenses regarding the establishment, addition to, or increase of activities within the City of Winter Springs, Florida, wherein intoxicating beverages are sold and consumed and topless dancing performances permitted. B. Establishments wherein applications for zoning, special exceptions, variances, and occupational licenses are requested for the ad- vertising and sale of pornographic materials. SECTION II. Officials, Department Heads and Staff Personnel of the City of Winter Springs, Florida, shall take notice of the 120-day extension effective the date of expiration of an existing 180-day moratorium established by Resolution No. 307. SECTION III. Copies of this Resolution shall be furnished to the following: A. Officials of the City of Winter Springs, Florida. B. Department Heads of the City of Winter Springs, Florida. C. Staff personnel of the City of Winter Springs, Florida. D. Appropriate officials of Seminole County including, but not limited to, the Board of County Commissioners, the Sheriff of Seminole County, and the Attorney for the County of Seminole. E. Such other officials as shall be deemed proper from time to time to enforce the tenure of this moratorium. PASSED and ADOPTED this 13 day of January, 1981. CITY OF WINTER SPRINGS, FLORIDA By: Troy J.
