HomeMy WebLinkAboutResolution 330 North Orlando Ranches RESOLUTION NO. 330 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, PROVIDING FOR THE PAVING AND DRAINAGE IN THE NORTH ORLANDO RANCHES, SECTIONS 2 AND 2A, AS WELL AS THAT PORTION OF THE SURVEY OF A PORTION OF BLOCK D OF THE D.R.MITCHELL SURVEY OF THE MOSES E. LEVY GRANT WHICH FRONTS THE WEST SIDE OF HAYES ROAD AND IS DIRECTLY ACROSS HAYES ROAD FROM NORTH ORLANDO RANCHES SECTIONS 2 AND 2A IN THE CITY OF WINTER SPRINGS, FLORIDA; PROVIDING FOR THE FINAL ASSESSMENT PURSUANT TO CHAPTER 170 OF THE FLORIDA STATUTES ON THE PROPERTIES BENEFITED BY SAID IMPROVEMENTS AND THE PROCEDURE THEREFORE TO DEFRAY THE EXPENSE ASSOCIATED WITH SAID IMPROVEMENTS; DESIGNATING THE PROPERTIES TO BE ASSESSED; DESIGNATING TOTAL COST OF THE IMPROVEMENT; CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Winter Springs, Florida, has determined it to be in the best interest of the City to provide for a public improve- ment in North Orlando Ranches, Sections 2 and 2A, as well as that portion of the survey of a portion of Block D of the D.R.Mitche11 Survey of the Moses E. Levy Grant which fronts the west side of Hayes Road and is directly across Hayes Road from North Orlando Ranches Sections 2 and 2A. in the City of Winter Springs, Florida and that the nature of said public improvement shall be the paving of streets and providing drainage therefore; and WHEREAS, the City is desirous of assessing the properties benefited by said public improvement to defray the expenditure of monies for said improvement pursuant to the terms of Chapter 170 of the Florida Statutes; and WHEREAS, the engineering firm of Clark, Dietz & Associates Engineers, Inc. has submitted an estimate of the construction costs of the paving and drainage on the streets to be improved; and WHEREAS, the City has been made aware of the necessity of said improvement, and WHEREAS, the actual construction costs for the aforesaid public improvement was less than the total estimated cost of said improvement there- fore allowing a reduction in the assessment as to each property benefited by said public improvement. FL 086721 JAN 20 9 37 AM '81 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - That there shall be a public improvement consisting of the paving of streets and provision for drainage therefore in the North Orlando Ranches Sections 2 and 2A, as well as that portion of the survey of a portion of Block D of the D.R. Mitchell Survey of the Moses E. Levy Grant which fronts the west side of Hayes Road and is directly across Hayes Road from North Orlando Ranches Sections 2 and 2A in the City of Winter ffi SECTION II - That there shall be an assessment on the properties benefited by the aforementioned public improvements pursuant rlO the terms of Chapter 170 of the Florida Statutes for 80 percent of cost of said public improvement to defray the expense therefore. SECTION III - The streets to be improved are that portion of Hayes Road bounded on the west by the Survey of a Portion of Block D of D. R. Mitchell Survey of the Moses E. Levy Grant, as recorded in Plat Book 13, pages 41 and 42, Public Records of Seminole County, Florida; and on the east by North Orlando Ranches, Sections 2 and 2A, as recorded in Plat Book 12, page 12 and Plat Book 12, pages 39-41, respectively, as recorded in the Public Records of Seminole County, Florida, as well as Coral Way, Silver Creek Drive, Dolphin Road, Marlin Road, Bonita Road, Tides Road and Sailfish Road. SECTION IV - That the lands upon which the assessment shall be levied are all of the lots and lands adjoining and contiguous or bounding and abutting upon such improvements or specially benefitted thereby and further designated by the assessment plat hereinafter provided for. SECTION V - The manner in which the aforementioned assessment shall be made is by the lineal front foot of properties fronting the streets and roads as hereinbefore mentioned in Section III and the "front" of said property shall be determined by the City Council of the City of Winter Springs, Florida. SECTION VI - That the assessments provided for herein shall be payable in ten (10) equal yearly installments and shall bear interest at the rate of eight percent (8%) per annum from the date of acceptance of the improvements provided for herein; however, said assessments may be paid without interest at any time within thirty (30) days after the improvement is completed and the resolution approving same has been adopted by the City Council of the City of Winter Springs, Florida. SECTION VII - That the total cost of the public improvement provided for herein is $440,232.98. SECTION VIII - Therefore that there shall be a reduction in the assessment as to each property because the actual construction cost for the aforesaid public improvement was less than the total estimated cost of said improvement as indicated in Resolution Number 248 passed and adopted the 23rd day of January 1979 by the City of Winter Springs, Florida. SECTION IX - That there shall be on file with the City Clerk of the City of Winter Springs, Florida, an assessment plat showing the area to be assessed with plans and specifications and the actual cost of the proposed improvement which shall be open to the inspection of the public. SECTION X - This Resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION XI - All resolutions or parts of resolutions in conflict with this resolution are hereby repealed. SECTION XII - This Resolution shall take Unmediate effect upon its passage and approval.
