HomeMy WebLinkAboutOrdinance 504 Disposal/Surplus Property ORDINANCE NO. 504 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, REPEALING SECTION 2-194, DISPOSAL OF SURPLUS PROPERTY, OF ARTICLE VI. FINANCE, AND PROVIDING FOR NEW SECTION 2-194, DISPOSAL OF SURPLUS PROPERTY OF ARTICLE VI. FINANCE, OF THE CODE OF ORDINANCES OF THE CITY OF WINTER SPRINGS, FLORIDA; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined it to be in the best interest of the public health, safety and welfare to amend Section 2-194. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - The present Section 2-194 Disposal of surplus property of Article VI. Finance, is hereby repealed, and the following replaced there- fore: ARTICLE VI. FINANCE Sec. 2-194. Disposal of surplus property. Property of the City that is obsolete or the continued use of which is uneconomical or inefficient or for which there is no useful function which property is not otherwise lawfully disposed of may be disposed of for value to any person or may be disposed of for value without bids to the state or if the property is without commercial value it may be donated, destroyed or abandoned. Property deemed surplus by the city manager shall be sold at public auction after publication of notice not less than fifteen (15) days prior to sale. SECTION II - That if any section or portion of a section or sub- section of this ordinance proves to be invalid, unlawful, unconstitutional, it shall not be held to invalidate or impair the validity, force, effect of any other section or portion of a section or subseciton or part of this ordinance. SECTION III - That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION IV - That this ordinance shall take effect immediately upon its passage and adoption.
