EMERGENCY ORDINANCE NO. 484
AN EMERGENCY ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, ACKNOWLEDGING THE ACQUISITION OF THE CITY'S EAST
SYSTEM FROM SEMINOLE UTILITY COMPANY AND ESTABLISHING
WATER AND SEWER USER CHARGES AND OTHER RELATED CHARGES
AND FEES FOR SAID EAST SYSTEM; PROVIDING SEVERABILITY,
CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, the City of Winter Springs, Florida, is acquiring the
assets of the former Seminole Utility Company including, but not
limited to, the wastewater treatment works and the water distribu-
tion system of said utility;
WHEREAS, the City of Winter Springs, Florida needs to es-
tablish a rate schedule of user fees and charges for the ter-
ritories currently served or proposed to be served by said was-
tewater treatment works and the water distribution system (herein-
after referred to as the "East System"); prior to acquisition and
WHEREAS, the City of Winter Springs, Florida, must pay the
operation, maintenance and replacement expenses associated with the
said East System, including debt service and depreciation, and
wishes to charge the users thereof accordingly; and
WHEREAS, the City will be faced with a crisis if an emergency
rate ordinance is not enacted prior to acquisition;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA;
SECTION I: The City of Winter Springs declares its intent to
operate the East System of the City's wastewater treatment works
and water distribution system in accordance with and pursuant to
the authority provided in each of the City's applicable existing
Ordinances relating to such operations except and unless the same
is in conflict with the water and sewer user charges and other
related charges and fees set forth herein.
SECTION II:
It is the desire of the City of Winter Springs
to gradually implement rates, fees, and charges for the East System
so that ultimately the authorized rates, fees, and charges of said
East System shall provide adequate funds for the operation,
maintenance, and replacement of the wastewater treatment works and
water distribution system, including debt service and depreciation.
To that end, the User Charge Schedule set forth in Section III
represents the first phase in the implementation of said rates,
fees and charges.
SECTION III:
That Section 16-51 User Charge Schedule of
Chapter 16 of the Code of Ordinances of the City of Winter Springs,
Florida, is hereby amended to add a User Charge Schedule for the
newly acquired East System.

The water rate shall include a base facility charge based on
the size of the meter plus a volume charge per one thousand (1/000)
gallons or a fraction thereof as set forth below:

The base facility charge will not be assessed if the service
is discontinued.
Water Meter Charges
The water meter charge shall be based on the size of the meter
as follows:

For all meters larger than two (2) inches, the water meter
charge shall be based upon the actual cost of the meter plus
materials and installation cost.
Sewer Rates
The sewer rate shall include a base facility charge based on
the size of the meter plus a volume charge per one thousand (1/000)
gallons or a fraction thereof as set forth below:

The base facility charge will not be assessed if the service
is discontinued.
Service Availability Charges
A service availability charge shall be assessed for each unit,
regardless of the number of units, as set forth below:

be used in establishing an Equivalent Residential Connection (ERC)
for the purposes of Guaranteed Revenues, calculating flow capacity
and for use in determining related permits:

anticipated daily flows as calculated by the City or the flow rates
contained in DER Technical Information Memorandum subject:
Estimated Sewage Flow. Separate laundry facilities for apartments
or multi-family complexes are not included in per unit flow rates
shown above.

Guaranteed Revenue Charges
The City will charge and collect guaranteed revenues from
property owners, builders, or developers in order to defray the
utility's cost for the ownership, operation and maintenance of
facilities and/or capacity dedicated or otherwise committed to such
property owner, builder, or developer, but not presently serving
customers. The City will only reserve capacity for such property
owners, builders, or developers when and to the extent that
guaranteed revenues are paid.
Guaranteed Revenue Charges
$256.00 (combined water and sewer) per ERC per year
Miscellaneous Charges
$10.00 reinstatement fee for turning on service after discon-
nection for non-payment of bill.
$50.00 fee or charge for actual damages, whichever is greater,
for contamination or alteration of a water meter, line, or
connection.
$20.00 inspection fee for each connection requested.
$10.00 fee for all checks returned by bank, includes
checks returned for non-sufficient funds or closed account.
$10.00 application fee.
$25.00 reinstallation charge for meter removed because of
nonpayment or inability to lock-off.
Pretreatment charge as established by the city commissioners
by resolution.
$65.00 deposit fee for residential users.
$200.00 deposit fee for nonresidential users.
Capacity reservation charge established by Developer Agree-
ment.
SECTION IV:
If any section or subsection of this Ordinance
proves to be invalid, unlawful or unconstitutional it should not
be held to invalidate or impair the validity, force or effect of
any other section or portion of a section or subsection part of
this Ordinance.
SECTION V: This Emergency Ordinance shall be repealed after
second reading and adoption of Ordinance No.
SECTION VI: All Ordinance or parts of Ordinance in conflict
with this Ordinance as it affects the East System are hereby
repealed.
SECTION VII: This Ordinance shall take immediate effect upon
its passage and approval.
