RESOLUTION NO. 285
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, REQUESTING INCLUSION IN THE APPLICATION
OF THE DEPARTMENT OF COMMUNITY AFFAIRS FOR
LOCAL PLANNING ASSISTANCE FUNDS: PROVIDING FOR
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Council of Winter Springs, Florida,
has recognized a need to provide for orderly growth and manage-
ment as contemplated by the passage of the Florida Local
Government Comprehensive Planning Act of 1975, and
WHEREAS, the HUD 701 Comprehensive Planning Assistance
Program administered by the Department of Community Affairs
provides funds to assist localities in meeting requirements of
this Act by preparing comprehensive plans, updating existing
plans, and preparing plan implementation mechanisms.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Winter Springs, Florida, that:
SECTION 1.
The Department of Community Affairs is
requested to consider including Winter Springs, Florida, in its
application to the U.S. Department of Housing and Urban Develop-
ment for local planning assistance funds for the fiscal year
beginning July 1, 1980.
The City Council of Winter Springs, Florida, indicates
its commitment to comply with the appropriate state and local
laws, rules, and regulations for the administration of this
program, including but not limited to, necessary matching funds,
funding only elgible planning activities, etc., which are more
fully described in Chapter 9B-4, F.A.C.
SECTION II. This Resolution shall remain in force
and effect until supplemented, amended, repealed or otherwise
altered.
SECTION III. All resolutions or parts of resolutions
in conflict with this Resolution are hereby repealed.
SECTION IV. This Resolution shall take immediate
effect upon its passage and approval.
PASSED AND ADOPTED this 22nd day of January,
1980.

Subject: Resolution Concerning 701 Planning Assistance Funds.
The attached resolution was prepared to be included with an
application to the State for preliminary ranking to determine
elgibility for 701 Comprehensive Planning Assistance Funds.
This application requires such a resolution be passed
assuring the local government1s commitment to abide by all regu-
lations in force when administering any funds to be granted,
as indicated in the attached letter from the Department of
Community Affairs.

Dear Local Official:
As you know, the Local Government Comprehensive Planning Act
of 1975 (LGCPA) requires that every local government prepare and
adopt a comprehensive plan. Because many local governments do not
have sufIicient resources to satisfy all planning requirements,
the Department of Community Affairs' '701' Comprehensive Planning
Assistance Program for 1980-81 is directed primarily toward
helping eligible cities and counties meet LGCPA requirements.
The '701' program provides grants of up to $20,000 to assist
localities in: developing comprehensive plans; updating existing
plans; or preparing plan implementation mechanisms. Funding is
provided for up to 2/3 of the cost of the planning program, with
a 1/3 matching share provided by each local grant recipient.
Comprehensive Planning Assistance grants are available to:
1. Municipalities having a population of less than 50,000
according to the 1970 census.
2. Counties not designated as urban counties by the Depart-
ment of Housing and Urban Development; and
3. Any group of eligible adjacent communities, either
incorporated or unincorporated, having a total population
of less than 50,000 according to the 1970 census.
Cities and counties in the above categories that have
previously received '7011 funds must meet HOD certification require-
ments to be eligible for further '701' planning assistance. Although
your community has not been certified, and, therefore, is not
presently eligible to receive a '7011 grant, you are encouraged to
complete and submit the enclosed '701' application form and resolu-
tion. All 1701' applicants will be ranked about two weeks after the
application deadlin~, and will be notified of that ranking. Based
upon the standing of your cOITmunity relative to other applicants,
you may decide at that time whether to proceed with an application
for certification.

The application for '701' assistance must contain two documents:
1. A resolution of the local governing body requesting
assistance under the program. Sample resolutions for
individual applicants and joint applicants are enclosed.
2. A completed application form which identifies the applicant,
provides fiscal information, and furnishes information
regarding local planning activities. An application form
is enclosed.
All applications and resolutions must be completed and
postmarked to the Department no later than January 31, 1980.
No applications will be accepted without both required documents.

Based upon current Departmental rules (Chapter 9B-4 F.A.C.),
grant recipients are selected on the basis of scores received from
both the initial application and a final application. However, the
Department has initiated an amendment to these rules which eliminates
the final application. If this rule amendment is adopted, a final
application will not be necessary, and '701' applicants will be ranked
and grant recipients selected on the basis of scores received for
planning need, fiscal effort, population change and planning commit-
ment. The proposed rule amendment will be announced in the
December 14, 1979, issue of the Florida Administrative Weekly.
A notice regarding the proposed amendment is enclosed.
