HomeMy WebLinkAboutResolution 280 Utility Easement RESOLUTION NO. 280 A RESOLlITION OF THE CITY OF HINTER SPRINGS, FLORIDA, VACATING, ABANDONING, AND CLOSING A UTILITY AND DRAINAGE EASEMENT HEREIN- BELOW DESCRIBED; CONFLICTS AND EFFECTIVE DATE: From the northwest corner of Lot 93, Oak Forest Unit One, as recorded in Plat Book 22, pages 81 through 83, Public Records of Seminole County, Florida, run S.85ol7'52"E. along the north line of said Lot 93, a distance of 7.5 feet to the east line of a 15 foot drainage and utility easement, as per Plat of said Oak Forest Unit One; thence run S.02o30'04" W. along said east line 48.55 feet to the point of beginning thence continue S.02o 30'04"W. 31.02 feet; thence N.85ol7'52" W. 3.56 feet; thence N.04o42'08"E. 31.00 feet; thence S.85ol7'52" E. 2.36 feet to the point of beginning. WHEREAS, a Petition was presented on behalf of Bel-Aire Homes, Inc., owners of Lot 93 Oak Forest, Unit I as recorded in Plat Book 22, Pages 81 through 83, Public Records of Seminole County, Florida, and lying and being in the incorporated territory of the City of Ivinter Springs, Florida, requesting the closing, vacating ani abandoning of the following described utility and drainage easement to-wit: From the northwest corner of Lot 93, Oak Forest Unit One, as recorded in Plat Book 22, pages 81 through 83, Public Records of Seminole County, Florida, run S.85ol7'52"E. along the north line of said Lot 93, a distance of 7.5 feet to the east line of a 15 foot drainage ;end utility easement, as per Plat of said Oak Forest Unit One; thence run S.02o30'04" W along said east line 48.55 feet to the point of beginning thence continue S.02o 30'04"W. 31.02 feet; thence N.85ol7'52"W. 3.56 feet; thence N.04o42'08"E. 31.00 feet; thence S.85ol7'52"E. 2.36 feet to the point of beginning. WHEREAS, after due consideration the City Council of Winter Springs having determined that the abandonment of the above-described utility and drainage easement is to the best interests of the city of ~rinter Springs and the public; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - That the City of Winter Springs, Florida, hereby abandons and vacates the utility and drainage easement described as follows: From the northwest corner of Lot 93, Oak Forest Unit One, as recorded in Plat Book 22, Pages 81 through 83, Public Records of Seminole County, Florida, run S.85ol7'52"E. along the north line of said Lot 93, a distance of 7.5 feet to the east line of a 15 foot drainage and utility easement, as per Plat of said Oak Forest Unit One; thence run S.02o30'04"W. along said east line 48.55 feet to the point of beginning thence continue S.02o 30'04"W. 31.02 feet; thence N.85ol7'52" W. 3.56 feet; thence N.04o42'08"E. 31.00 feet; thence S.85ol7'52"E. 2.36 feet to the point of beginning. SECTION II - This resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION III -All resolutions or parts of resolutions in conflict with this resolution are hereby repealed. SECTION IV - This resolution shall take immediate effect upon its passage and approval. PASSED and ADOPTED this 30th day of October, 1979. SECTION II - This resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION III - All resolutions or parts of resolutions in conflict with this resolution are hereby repealed. SECTION IV - This resolution shall take immediate effect upon its passage and approval.
