HomeMy WebLinkAboutResolution 268 Property Assessments RESOLUTION 268 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, PROVIDING FOR THE APPROVAL AND CONFIRMATION OF THE DECISION OF THE EQUALIZATION BOARD CONCERNING THE ASSESSMENTS PROVIDED FOR IN RESOLUTION NO. 259 HERETOFORE ADOPTED, PURSUANT TO CHAPTER 170.08 OF THE FLORIDA STATUTES; PROVIDING FOR THE ASSESSMENTS TO BE ASSESSED ON THE LINEAL FRONT FOOT OF PROPERTIES FRONTING NORTH AND SOUTH EDGEMON AVENUE; PROVIDING FOR A CREDIT TO BE GIVEN TO EACH ASSESSMENT ON COMPLETION OF THE IMPROVEMENT IN THE AMOUNT OF THE DIFFERENCE IN THE ASSESSMENT AS HEREIN APPROVED AND CONFIRMED AND THE PROPORTIONATE PART OF THE ACTUAL COST OF SAID IMPROVEMENT TO BE PAID BY SPECIAL ASSESSMENT AS FINALLY DETERMINED UPON THE COM- PLETION OF SAID IMPROVEMENT; PROVIDING FOR THE AMENDMENT OF THE ASSESSMENT ROLE AND ASSESSMENT PLAT; CONFLICTS AND EFFECTIVE DATE. WHEREAS, Chapter 170.08 of the Florida Statutes requires that the governing authority municipality meet as an Equalizing Board to hear and consider any and all complaints as to special assessments and shall adjust and equalize said assessments on the basis of justice and right, and to approve and to confirm said assessments when so equalized by resolution; and, WHEREAS, Chapter 170.08 further provides that upon completion of the improvement, the municipality shall credit to each of said assessments, the difference in the assessment as originally made, approved and confirmed, and the proportionate part of the actual cost of said improvement to be paid by special assessments as finally determined upon the completion of said improvement; and, WHEREAS, the City of Winter Springs City Council sat in the capacity of an Equalization Board after proper notice pursuant to Chapter 170.07 of the Florida Statutes on the 7th day of August, 1979. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - That the assessments provided for in Resolution No. 259 heretofore adopted by the City of Winter Springs, Florida, have been adjusted and equalized to provide for the assessment to be assessed against the lineal front foot of properties fronting North and South Edgemon Avenue fronting the municipal improvements provided therein. SECTION II - That said assessments are hereby approved and confirmed after the consideration and the hearing of all complaints as to said special assessments and the adjustment and equalization having been completed by the Equalization Board. SECTION III - That said assessments shall be further reduced by a credit to be given to each assessment in the amount of the difference in the assess- ment as originally made and herein confirmed and the proportionate part of the actual cost of said improvement to be paid by special assessments as finally determined upon the completion of said municipal improvement. SECTION IV - This Resolution shall remain in force until supplemented, amended, repealed or otherwise altered. SECTION V - All Resolutions or parts of Resolutions in conflict with this Resolution are hereby repealed. SECTION VI - This Resolution shall take immediate effect upon its passage and approval.
