RESOLUTION NO. 263
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, ESTABLISHING A TIME AND PLACE AT
WHICH THE OWNERS OF PROPERTY TO BE ASSESSED
PURSUANT TO RESOLUTION NO. 259, OR ANY OTHER
PERSONS INTERESTED IN SAID ASSESSMENT MAY
APPEAR BEFORE THE CITY COUNCIL AND BE HEARD
AS TO THE PROPRIETY AND ADVISABILITY OF
MAKING THE MUNICIPAL IMPROVEMENTS, THE COSTS
THEREOF AND THE MANNER OF PAYMENT THEREFOR
AND AS TO THE AMOUNT THEREOF TO BE ASSESSED
AGAINST EACH PROPERTY SO IMPROVED PURSUANT
TO CHAPTER 170.07 OF THE FLORIDA STATUTES:
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, Chapter 170.07 of the Florida Statutes
requires that the governing authority of a municipality which
is assessing improved property owners to defray part of the costs
for municipal improvements to fix a time and place by Resolution
at which the owners of property to be assessed or any other persons
interested therein may appear before said governing authority and
be heard as to the propriety and advisability of making such im-
provements, as to the costs thereof, as to the manner of payment
therefor and as to the amount thereof to be assessed against
each property so improved; and
WHEREAS, Chapter 170.08 of the Florida Statutes requires
the governing authority of a municipality which is assessing for
municipal improvements to meet as an equalizing board at the time
and place set herein to hear and consider any and all complaints
as to such special assessments and shall adjust and equalize said
assessments on a basis of justice and right.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF
WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I. That the City Council of the City of
Winter Springs, Florida, shall meet as an equalizing board on
the 7th day of August, 1979, at the Winter Springs Community
Building, Winter Springs, Florida, to hear and to consider any
and all complaints as to the special assessments to be made for
the paving and drainage improvements of North and South Edgemon
Avenue, and shall adjust and equalize said assessments on a basis
of justice and right.
SECTION II. That said meeting shall be open to
property owners of property to be assessed, or any other persons
interested therein, and that said persons will be heard as to
the propriety and advisability of making such improvements, as
to the cost thereof, as to the manner of payment therefor and
as to the amount thereof to be assessed against each property so
improved.
SECTION III. This Resolution shall remain in force
until supplemented, amended, repealed or otherwise altered.
SECTION IV. All resolutions or parts of resolutions
in conflict with this Resolution are hereby repealed.
SECTION V. This Resolution shall take immediate effect
upon its approval and passage.
