RESOLUTION NO. 261
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, PROVIDING FOR THE APPROVAL AND CONFIR-
MATION OF THE DECISION OF THE EQUALIZATION BOARD
CONCERNING THE ASSESSMENTS PROVIDED FOR IN RESOLU-
TION NO. 248 HERETOFORE ADOPTED, PURSUANT TO
CHAPTER 170.08 OF THE FLORIDA STATUTES; PROVIDING
FOR THE ASSESSMENTS TO BE ASSESSED ON THE LONGEST
SIDE FRONTING THE STREET TO BE PAVED ON ALL CORNER
LOTS; PROVIDING FOR A CREDIT TO BE GIVEN TO EACH
ASSESSMENT ON COMPLETION OF THE IMPROVEMENT IN
THE AMOUNT OF THE DIFFERENCE IN THE ASSESSMENT
AS HEREIN APPROVED AND CONFIRMED AND THE PROPOR-
TIONATE PART OF THE ACTUAL COST OF SAID IMPROVEMENT
TO BE PAID BY SPECIAL ASSESSMENT AS FINALLY DETERMINED
UPON THE COMPLETION OF SAID IMPROVEMEN~ PROVIDING FOR
THE AMENDMENT OF THE ASSESSMENT ROLE AND ASSESSMENT
PLAT; CONFLICTS AND EFFECTIVE DATE.
WHEREAS, Chapter 170.08 of the Florida Statutes
requires that the governing authority municipality meet as
an Equalizing Board to hear and consider any and all complaints
as to special assessments and shall adjust and equalize said
assessments on the basis of justice and right, and to approve
and to confirm said assessments when so equalized by resolution;
and,
WHEREAS, Chapter 170.08 further provides that upon
completion of the improvement, the municipality shall credit
to each of said assessments, the difference in the assessment
as originally made, approved and confirmed, and the proportionate
part of the actual cost of said improvement to be paid by special
assessments as finally determined upon the completion of said
improvement; and,
WHEREAS, the City of Winter Springs City Council sat
in the capacity of an Equalization Board after proper notice
pursuant to Chapter 170.07 of the Florida Statutes on the 17th
day of April, 1979, the 1st day of May 1979, on the 8th day
of May 1979, and on the 22nd day of May, 1979, as well as
held a workshop on the 5th day of May, 1979.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - That the assessments provided for
in Resolution No. 248 heretofore adopted by the City of Winter

Springs, Florida, have been adjusted and equalized to provide
for the assessment to be assessed against the longest side
on corner lots fronting the municipal improvements provided
therein.
SECTION II - That said assessments are hereby approved
and confirmed after the consideration and the hearing of all
complaints as to said special assessments and the adjustment
and equalization having been completed by the Equalization
Board as outlined in Section I herein, which has the effect
of increasing the total footage fronting on those streets
and roads to be improved a total of 714.50 feet, which in turn
reduces the total assessment per foot from $17.69 to $17.17 based
upon the 80% assessment as provided in Resolution No. 248.
SECTION III - That said assessments shall be further
reduced by a credit to be given to each assessment in the amount
of the difference in the assessment as originally made and herein
confirmed and the proportionate part of the actual cost of said
improvement to be paid by special assessments as finally determined
upon the completion of said municipal improvement.
SECTION IV - That the assessment role and assessment
plat heretofore completed shall be amended to reflect the decision
of the Equalization Board as previously mentioned.
SECTION V - This Resolution shall remain in force until
supplemented, amended, repealed or otherwise altered.
SECTION VI - All Resolutions or parts of Resolutions in
conflict with this Resolution are hereby repealed.
SECTION VII - This Resolution shall take immediate effect
passage and approval.
