HomeMy WebLinkAboutOrdinance 476 Amending Comprehensive Plan ORDINANCE NO. 476 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH FLORIDA STATUTE 163.3184; PROVIDING FOR THE RECLASSIFICATION OF PROPERTY TO COMMERCIAL ON THE ADOPTED LAND USE MAP; PROVIDING FOR THE REZONING OF THE PROPERTY TO C-1 ON THE OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. WHEREAS, the owner of the property described below, AKE, Inc., has petitioned the City of Winter Springs, Florida, to reclassify the land use of the property to Conunercial and to rezone the property to C-1 Neighborhood Camnercial: The West 231.30 ft. of Lot 8, Block D, D.R.Mitchell's Survey of the Levy Grant, Plat Book 1, Page 5, Public Records of Seminole County; and WHEREAS, a portion of the property has been reserved for inclusion in the right-of-way of State Road No. 434 by the Florida Department of Transportation Right-of-Way Reservation Map filed September 29, 1988, Map Book 1, Pages 71-79, Public Records of Seminole County; and WHEREAS, the City of Winter Springs, Florida, has considered the assignment of the Conunercial land use classification for the said property on the Land Use Map of the City in accordance with Florida Statute 163.3184 and has determined that the reclassification of the property on the Land Use Map to Conunercial, excluding the reserved additional right-of-way for SR 434, which will remain unchanged, is consistent with the Comprehensive Plan of the City of Winter Springs, Florida; and WHEREAS, the City Conunission has determined that the rezoning of the reclassified property to C-1 Neighborhood Commercial on the Official Zoning Map is in the interest of the City of Winter Springs, Florida. NCM THEREFORE, BE IT RESOLVED BY THE CITY CCMI1ISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT: SECTION I - The Comprehensive Plan of the City of Winter Springs, Florida, is hereby amended to reclassify the property described below to Camnercial on the Adopted Land Use Map: The West 231.30 ft. of Lot 8, Block D (less the North 71 ft. duly reserved for right-of-way by the Reservation Map ci ted hereinabove), D.R. Mitchell's SUrvey of the Levy Grant, Plat Book 1, Page 5, Public Records of Seminole County . SECTION II - The reclassified property is hereby rezoned to C-1 Neighborhood Conunercial and shall be so specified on the Official Zoning Map of the City.
