RESOLUTION NO. 246
A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, VACATING A PORTION OF THE PLAT OF
NORTH ORLANDO, FIRST ADDITION, PLAT BOOK 12,
PAGES 23 AND 24, PUBLIC RECORDS OF SEMINOLE
COUNTY, FLORIDA, WHICH FALL WITHIN THE RECENTLY
RECORDED PLAT FOR SECTION 6 OF THE HIGHLANDS,
PLAT BOOK 22, PAGES 18 AND 19, PUBLIC RECORDS
OF SEMINOLE COUNTY, FLORIDA; THIS VACATION
INVOLVES RIGHTS-OF-WAY FOR NORTH FIRST STREET
AND ALGIERS AVENUE AS WELL AS A SEVEN-FOOT
UTILITY EASEMENT ALONG THE REAR OR EAST
BOUNDARY OF LOTS 19 THROUGH 25, BLOCK 26,
NORTH ORLANDO, FIRST ADDITION, PLAT; CONFLICTS
AND EFFECTIVE DATE.
WHEREAS, the Florida Land Company has requested the City
of Winter Springs, Florida, to vacate a portion of public streets and
utility easements recorded in North Orlando, First Addition, Plat
Book 12, pages 23 and 24, Public Records of Seminole County, Florida,
due to the fact that they failed to procure said vacation prior to the
recording of the plat for Section 6 of The Highlands, Plat Book 22,
pages 18 and 19, Public Records of Seminole County, Florida, and thus
have over-platted a portion of the First Addition; and
WHEREAS, it has been represented to the City of Winter
Springs, Florida, by Florida Land Company that they are in fact the
fee simple owners of all the land described in the plat of The
Highlands, Section 6, Plat Book 22, pages 18 and 19, Public Records
of Seminole County, Florida, and that all property affected by the
requested vacation is presently undeveloped with no streets or drain-
age improvements having been constructed to serve the rights-of-way
recorded in the earlier plat of the North Orlando, First Addition; and
\~EREAS, the Florida Land Company has represented to the
City that this request would not adversely affect any of the adjacent
land owners since no improvements have been constructed nor are in use
at this time and that access to lots adjacent to the affected property
is provided from Bombay Avenue and that portion of North First Street
east of Section 6; and

WHEREAS, the City of Winter Springs, Florida, feels that
it is in the public interest of the citizens of Winter Springs, Florida,
to provide clear title to the lots in Section 6 of the Highlands, Plat
Book 22, pages 18 and 19, Public Records of Seminole County, Florida,
by abandoning the aforementioned rights-of-way and easements due to the
fact that no property interest of others will be adversely affected.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - That portion of the plat of North Orlando,
First Addition, Plat Book 12, pages 23 and 24, Public Records of
Seminole County, Florida, which also fall within the recently recorded
plat for Section 6 of The Highlands, Plat Book 22, pages 18 and 19,
Public Records of Seminole County, Florida, is hereby vacated.
SECTION II - That this vacation involves rights-of-way for
North First Street and Algiers Avenue, as well as a seven-foot utility
easement along the rear or east boundaries of Lots 19 through 25,
Block 26, as recorded in the North Orlando, First Addition plat.
SECTION III - This resolution shall remain in force until
supplemented, amended, repealed or otherwise altered.
SECTION IV - All resolutions or parts of resolutions in
conflict with this resolution are hereby repealed.
SECTION V - This resolution shall take immediate effect
upon its passage and approval.
PASSED and ADOPTED this 30th day of January,
1979.
