RESOLUTION NO. 229
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, FIXING THE FEE PER
POLE AND FIXTURE TO BE PAID BY DEVELOPERS WITHIN THE CITY TO OFFSET
INCREASED MONTHLY SERVICE CHARGES OF ELECTRIC UTILITIES WITHIN THE
CITY: CONFLICTS: AND EFFECTIVE DATE.
WHEREAS, Florida Power Corporation has revised its policy regarding
monthly M-1 Municipal street lighting billing rates; and
WHEREAS, the City has considered the change in the Florida Power
Corporation's policy of accepting initial cash payment in lieu of monthly
fixture charges for street lighting fixtures; and
WHEREAS, it is eminently necessary for the City of Winter Springs to
fex the fee per pole and fixture to be paid by developers within the City to
offset said monthly service charges of the investor-owned electric utility,
Florida Power Corporation, and other investor-owned electric utilities
similarly situated.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - All developers of subdivided lands within the City of
Winter Springs, Florida, shall be required to pay unto the City of Winter
Springs, Florida, a pole and fixture lighting fee of Two Hundred Fifty
Dollars ($250.00) per pole and fixture, which sum shall be used by the City
to offset the monthly service charge to the City of Winter Springs, Florida.
SECTION II - All developers of subdivided lands within the City of Winter
Springs, Florida, shall pay the pole and fixture lighting fee of Two Hundred
Fifty Dollars ($250.00) per pole and fixtue simultaneously with the issuance
of the initial building permit germane to any construction within said develop-
ment.
SECTION III - All developers of subdivided lands as described herein shall
pay the required pole and fixture lighting fee for each pole and lighting fix-
ture approved by the City as a part of the developers approved lighting design
plan.
SECTION IV - The City shall establish an account for the deposit of the pole
and fixtue lighting fees, which account shall bear interest compounded daily
at not less than five and one-quarter percent (5 1/4). The principal and interest
deposited to said account shall be disbursed periodically by the City to defray
each month the charge to the City for pole and fixture rentals of all investor-
owned electric utilities operating within the City.
SECTION V - This Resolution shall remain in force until supplemented,
amended, repealed, or otherwise altered.
SECTION VI - All resolutions, or parts of resolutions in conflict with
this resolution are hereby repealed.
SECTION VII - This Resolution shall take immediate effect upon its passage
and approval.
