RESOLUTION NO. 219
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF WINTER SPRINGS, FLORIDA, INDICATING ACKNOWLEDGE-
MENT OF THE "208" MANAGEMENT AGENCY RESPONSIBILITIES
AND THE CITY'S INTENT CONCERNING PROCEEDING WITH
SUCH PROGRAM WITH OTHER GENERAL PURPOSE UNITS
OF LOCAL GOVERNMENT IN THE ORLANDO METROPOLITAN
"208" PLANNING AREA AND THE CITY'S INTENT CONCERN-
ING THE IMPLEMENTATION OF THE "208" PLANNING PROGRAM.
WHEREAS, pursuant to Section "208" of the Federal
Pollution Control Act Amendments of 1972, Public Law 92-500
(hereinafter called "the Act"), the Administrator of the
United States Environmental Protection Agency has by regula-
tion published guidelines for the preparation of "208" Planning
Programs in those areas which, as the result of urban-industrial
concentration or other factors, have substantial water quality
control problems; (45 C.F.R. Part 131); and
WHEREAS, the Orlando Metropolitan "208" Planning
Area (hereinafter called lithe Planning Area") has been desig-
nated as an appropriate area for the preparation of a "208"
Plan and the establishment of a "208" continuing planning
process; and
WHEREAS, certain Federal guidelines require, among
other things, that the affected general purpose units of
local government within the planning area indicate their
awareness, through formally adopted resolutions, of their
responsibilities as management agencies in the "208" water
quality management planning process for the development
and implementation of activities which will result in an
integrated water quality management program for the planning
area; and
WHEREAS, the "208" Planning Program, to include
the "208" Plan and continuing planning process, is intended
to identify coordinated, cost-effective procedures for pre-
venting, abating and solving existing and potential substant-
ial water quality control problems, determine appropriate
measures to control present point and non-point sources
of water pollution, and to guide future development and
growth in the planning area which may affect water quality;
and
WHEREAS, certain responsibilities have been identified
or will be identified in the "208" Plan for application
by each general purpose unit of local government; and
WHEREAS, additional activities and responsibilities
may be identified in the "208" continuing planning process.
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Winter Springs, Florida, that:
1. The City of Winter Springs, Florida, accepts
the designation as a management agency in the "208" water
quality management program.
2. The City of Winter Springs, Florida, intends
to support the proposed "208" water quality monitoring programs
and planning programs.
3. The City of Winter Springs, Florida, accepts
the designation of a water quality management planning agency
within the jurisdictional boundary of the City of Winter
Springs, Florida.
4. The City of Winter Springs, Florida, recognizes
and understands that certain responsibilities have been
identified in the "208" Plan and the planning process.
IT IS FURTHER RESOLVED that the City of Winter
Springs, Florida, recognizes that the designation as a "208"
management agency entails the performance of certain designated
responsibilities, as well as any additionally mutually agreed
responsibilities identified in future "208" Plan updates
and/or revisions and understands the responsibilities to
be those identified in this Resolution and those identified
in the "208" Plan and agrees to accept those responsibilities
provided that sufficient financial resources (to include
requested state and/or federal financial assistance) are
available, and that the priorities for implementation are
sole prerogative of the City of Winter Springs, Seminole
County, Florida, according to local needs and financial
capabilities.
