ORDINANCE NO. 449
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
REPEALING SECTIONS 16-46, 16-49 and 16-51 OF ARTICLE
III USER FEES AND CHARGES OF CHAPTER 16; PROVIDING
FOR THE ADOPTION OF NEW SECTIONS 16-46, 16-49 AND
16-51 OF ARTICLE III USER FEES AND CHARGES, OF
CHAPTER 16; PROVIDING SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS THE CITY COMMISSION of the City of Winter Springs,
Florida, has determined it to be in the best interests of the safety,
health, and welfare of the citizens of the City of Winter Springs to provide
for the adoption of User Fees and Charges relating to wastewater and fresh
water and
WHEREAS, it is necessary to update these Codes from time to
time.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA:
SECTION I - That Section 16-46. Late Payments of Chapter 16
of the Code of Ordinances of the City of Winter Springs, Florida, is hereby
deleted in its entirety, and the following replaced therefore:
SEC. 16-46. LATE PAYMENTS
Users of the Wastewater treatment and fresh water distribution
system shall be billed monthly and payment shall be due upon receipt of the
bill. A payment not received within fifteen days from the date of mailing the
bill shall be delinquent, and a delinquency notice shall be mailed. Service
shall be discontinued if the delinquency is not cured within five days from the
date of mailing the delinquency notice. A fee of ten dollars ($10.00) shall be
assessed to reinstate service and a fee of twenty-five dollars ($25.00) shall be
assessed for reinstallment of a meter if removed for nonpayment or unable to
lock-off. A fee of ten dollars ($10.00) shall be assessed for each check
returned for insufficient funds or closed account. Any customer who has two
returned checks within a six month period will be required to make payment in
cash or by money order.
SECTION II - That Section 16-49 Application Requirements of Chapter
16 of the Code of Ordinances of the City of Winter Springs, Florida, is hereby
deleted in its entirety, and the following replaced therefore:
SEC. 16-49 APPLICATION REQUIREMENTS
All applications shall be made at the business office during
office hours.
Each applicant shall be required to provide information and pay
fees at the time of application.
(a) Residential Users. Application shall include but not be
limited to the following information:
1. Name(s) of applicant;
2. Address for which the service is requested and the residence
of the applicant, if different; and
3. Residence telephone number of the applicant at the service
address and at the residence address, if different.
A deposit fee and an application fee shall be assessed at the time of
application. The deposit fee shall accrue interest at the rate of six (6)
percent per annum and shall be paid when service is terminated. When service
is terminated, the deposit plus the interest less any outstanding fees and
charges shall be refunded to the user. There will be no interest refunded on
any account which has been in service six months or less.
An inspection fee shall be assessed at application and for each
connection when applicable. Refer to miscellaneous charges.
(b) Non-residential users. Application shall include such
information as the Utility Manager prescribes and that is necessary for
classification, reference, and other similar identification purposes.

of application. The deposit fee shall accrue interest at the rate of 6 percent
per annum and shall be paid when service is terminated. When service is
terminated, the deposit plus interest shall be refunded to the user. There
will be no interest refunded on any account which has been in service six months
or less.
An inspection fee shall be assessed at application and for each
connection when applicable. Refer to miscellaneous charges.
SECTION III - That Section 16-51 USER CHARGE SCHEDULE of Chapter
16 of the Code of Ordinances of the City of Winter Springs, Florida, is hereby
deleted in its entirety, and the following replaced therefore:
SEC. 16-51. USER CHARGE SCHEDULE.

The base facility charge will not be assessed if the service is

A service availability charge shall be assessed for each unit,
regardless of the number of units, as set forth below:

MISCELLANEOUS CHARGES
$10.00 reinstatement fee for turning on service after dis-
connection for non-payment of bill.
$50.00 fee or charge for actual damages, whichever is greater,
for contamination or alteration of a water meter, line, or
connection.
$20.00 inspection fee for each connection requested.
$10.00 fee for all checks returned by bank, includes checks
returned for non-sufficient funds or closed account.
$10.00 application fee.
$25.00 reinstallation charge for meter removed because of non-
payment or unable to lock-off.
Pretreatment charge as established by the City Commission by Res-
olution.
$65.00 deposit fee for the residential users.
$200.00 deposit fee for non-residential users.
Capacity reservation charge established in a Developer Agreement.
SEC. 16-52 SEVERABILITY.
If any section or subsection of the Ordinance proves to be in-
valid, unlawful, or unconstitutional, it should not be held to invalidate or
impair the validity, force or effect of any other section or portion of a section
or subsection or part of this Ordinance.
SEC. 16-53 CONFLICTS.
All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
SEC. 16-54. EFFECTIVE DATE.
This Ordinance shall take effect immediately upon its final
passage and adoption.

Passing on Increased Sewer Connection Fees to Current
Developers

Dear Dick:
This letter is in response to your question of whether the
City of winter Springs can pass on the increase of sewer connection
fees to developers who have a Development Agreement but have not,
as yet, opted to utilize the allocation. I have reviewed the
standard Developer Agreement, and under the Rates Provision of this
Agreement, it is provided that the City may establish, amend or
revise the rules and regulations covering water and sewer services
to the Property, including the costs thereof.
It is clear that the City may increase sewer connection fees
to developers who have a Developer Agreement, under the terms of
the Developer Agreement. The Rates Provision of the standard
Developer Agreement states specifically:
The City agrees that the rates to be charged
to Developer and individual consumers of water
and sewer services shall be those set forth by
ordinance of the City.
Notwithstanding any provision of this Agree-
ment, the City may establish, amend or revise,
from time to time, in the future, and enforce
rules and regulations covering water and sewer
services to the Property, including the costs
thereof.

Any such initial or future lower or increased
rate schedules, and rules and regulations
established, amended or revised and enforced
by the City from time to time in the future,
as provided by law, shall be binding upon
Developer; upon any person or other entity
holding by, through or under Developer; and
upon any user or consumer of the water and
sewer service provided to the Property by the
City.

The question is - Can we pass on the increase to those
developers who have a developer agreement but have not as

Dear Mr. Rozansky:
We have prepared this letter report identifying the estimated water and
wastewater connection fees for the City of Winter Springs in conjunction with
the Master Water and Wastewater Plans. A connection fee report was not
described as part of the original Scope of Services and is provided to the City
because the Master Water and Wastewater Plans were completed within the budget
and funds were available to provide this needed additional information.
DEFINITION OF CONNECTION FEE
Connection fees are one-time charges per equivalent residential unit (ERU) or
gallon of usage for water and sewer improvements needed for expansion to serve
new future users. They are generally separate fees for water and sewer which
include all project costs such as construction, engineering, surveying, land,
financing, and related administrative and legal costs. Connection fees include
only facilities required for expansion and do not include upgrading
improvements or changes required by new regulations. Because of changing legal
requirements, it will be necessary for the City Attorney to review the latest
legal aspects of connection fees and the methods used herein for connection fee
calculation.
PORTION OF PROJECT COSTS TO BE INCLUDED IN CONNECTION FEES
All project costs associated with the construction, engineering, design, legal,
administrative, interest, financing, and other appropriate costs to expand the
. '.
water and wastewater facilities to serve future users may be included in the
water and wastewater connection fees. We have included these costs with the
exception of interest and financing on the projected projects contained within
the Master Water and Wastewater Plans. The City can elect to establish a
connection fee schedule based upon some percentage of the calculated fee
contained herein.

WATER SYSTEM IMPROVEMENTS
The existing water treatment facilities are generally adequate to serve
existing customers and planned expansions will be constructed primarily to
serve new growth. A Water System Master Plan was developed for the City in
June 1987 and is the basis for projected water system improvements and
expenditures. A brief review of the various expansion elements required for
the 20-year planning period from 1987 to 2010 is provided below:
1) Construction of Wells #5 and #6 and Aerators (1988 & 1989)
Additional wells were required to upgrade the system as described in the
bond issue and purchase. Therefore, a portion of the cost for these
facilities will not be allocated to the connection fees required. The
total cost for well #5 including the well abandonment is approximately
$140,000. The projected cost for well #6 is $100,000 and the aerators is
$50,000 each. To meet existing needs, a capacity of 1750 gpm (875 gpm per
plant) is needed. Presently, there are two wells with a capacity of 1100
each with no backup. Therefore, 875 gpm of each of the new wells were
required to meet existing needs and backup requirements. The capacity of
the new wells will be 2400 gpm and an allocation of 1525 gpm or 63.5% per
well should be made to the connection fee. The present aerator capacity is
1800 gpm, which exceeds the present needs. The new aerators will have a
capacity of 2600 gpm, which requires an allocation of 800 gpm capacity or
31% to the connection fee.
2) Ground Storage (1995 and 2005)
Additional ground storage is required at both water treatment plants.
These facilities are entirely for future growth and connections. The
estimated cost including site piping is $470,000 arid has a 100% allocation

3) High Service Pumping (1997 and 2007)
Additional high service pumping will be required at both water treatment
plants. These facilities are entirely for future growth and connections.
The estimated cost including piping is $60,000 and has a 100% allocation to
the connection fee.
4. Ton Chlorination Facilities
The existing chlorination facilities are inadequate to meet the future
needs of the system. The systems must be expanded by providing ton
chlorine cylinders, a beam balance scale, automatic switchover and larger
capacity chlorinators. The existing system serves a population of 13,245
and will meet the needs thru 2010 at a population of 23,549. Therefore,
the system will provide for a service population of 10,304 or 43.8%. The
estimated cost of these improvements is $80,000 and has an allocation of
$35,000.
5) Auxiliary Power
The existing water system is equipped with auxiliary power via individual
propane powered engines for the two wells and two high service pumps. This
is adequate to meet existing needs only. New auxiliary power is proposed
for both facilities capable of operating the entire facility. The
allocation is identical to the ton chlorination system above or 43.8% of
the total estimated cost of $100,000.
6) Distribution System
Improvements are required to the distribution system to meet the future
demands in newly developed areas. Since these impr:ovements are not
necessary to provide the present customers with better service, 100% of
these costs are allocated to the connection fee. Total estimated cost is
approximately $148,800. ..

Effect on Water Connection Fee
These facilities will service the additional population change to the year 2010
or approximately 10,304 people. The design per capita usage is 95 GPCD and
yields 978,880 gallons of capacity. The estimated connection fee is equal to
the projected costs divided by the projected benefit and equals approximately
$0.96 per gallon. The current fee of $1.12 per gallon does not require
adjustment as other factors such as bonding (or financing) and inflation have
not been included in the cost estimates.
A summary of the projected costs and allocations is shown on Table I.
Additional detail on the items discussed above may be found in the Master Water
Plan.
WASTEWATER SYSTEM IMPROVEMENTS
The existing wastewater collection system and treatment facilities, upon
completion of ongoing construction, will generally be adequate to serve
existing customers. Expansion planned for the future will primarily be for
future growth and, therefore, 100% of the projected costs will be allocated to
connection fees where applicable. A Master Wastewater Plan was developed for
the City in August 1987 and is the basis for projected wastewater system
improvements and expenditures. A discussion of the expansion improvements
required to serve the City through the year 2005 is provided below.
1) Wastewater Treatment
The Winter Springs wastewater treatment facility has recently been upgraded
to provide a public access level of treatment. This allows effluent to be
used as an irrigation source within public access areas, i.e., golf courses
and private residences, etc. In addition, the City, purchased a second

package treatment plant increasing the biological treatment capacities of
the facility to 3.0 MGD. The filtration, chlorination and sludge handling
facilities will also be increased to.a treatment capacity of 3.0 MGD. The
total projected costs for all proposed and ongoing treatment plant
improvements are approximately $2,196,750 which will be totally allocated
to connection fees.

2) Effluent Disposal
Effluent disposal is the limiting factor for development of new capacity
for growth. Currently the effluent disposal capacity is 1.35 MGD. By the
year 2010, the capacity will be 2.23 MGD and will exceed the need at that
time by 0.23 MGD. All costs associated with developing new disposal sites
are allocated to the connection fee. It was assumed that development of
new effluent disposal sites would continue at the same cost to a capacity
capability of 3.0 MGD.
3) Lift Stations
The improvements needed to existing lift stations are not required until
1990. Since lift station 10 only requires modification due to new growth
(rehabilitation is not required), 100% of the projected cost was allocated
to the connection fee. The projected cost is $190,810. The equivalent
capacity served between 1990 and 2010 is approximately 0.87 MGD. Other
improvement costs were incidental and were not included in the connection
fee analysis.
WASTEWATER CONNECTION FEE
The expansion improvements shown in Table II will provide additional wastewater
treatment and disposal capacity. The table subdivides the wastewater system
into three categories. We must assume that development of irrigation systems
for effluent disposal will not decrease in cost per gallon. Therefore, the
combination of all three categories is equivalent to the projected connection
fee per gallon to increase the wastewater system to a capacity of three million
gallons per day. The collection system (not including existing lift stations
and forcemain improvements) required to serve the future growth is not included
as part of the connection fee. The collection system ~ll be constructed by
the individual property developers and connected to the existing system. The
developers will also be required to provide any new lift stations to serve

their properties.

The projected costs contained herein do not include an allowance for bonding or
financial costs or inflation. Such items may increase the projected costs and
affect the projected connection fee. Corrections can be made in the future to
compensate for these increases, if required.
The figures contained within this report indicate that the connection fee for
wastewater should be increased from the current $3.10 per gallon to
approximately $6.30 per gallon to meet the future needs.
CONNECTION FEE IMPLEMENTATION
The City may consider the adoption of connection fee schedule using a
percentage of the calculated fees presented herein. For general reference,
Table IV presents current water and sewer connection/impact fees for other
Central Florida Governments.
Collection of these fees will occur over the planning period as each project is
completed and capacity becomes available for sale. Collection will also be
affected by the demand for new utility services by development. The program
described within the Master Water and Wastewater Plans phases the construction,
which provides the City with flexibility both for implementation and
expenditures.
Because several municipalities have experienced legal problems and challenges
with the establishment of connection fees, proper implementation is very
important as you are well aware. The methodology of fee calculation and the
details of the implementation procedure should be given a careful legal review
by the City Attorney. The City has an approved User Charge Ordinance,
Ordinance No. 356, that was incorporated into the City Code after approval on
December 8, 1986. We believe that modification to this ordinance may be
appropriate to reflect any new connection fees adopted~.
