AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE CCM?REHENSIVE PLAN IN ACCORDANCE WITH FLORIDA
STATUTE 163.3187; PROVIDING FOR THE RECLASSIFICATION OF
PROPERTY TO COMMERCIAL ON THE ADOPTED LAND USE MAP;
PROVIDING FOR THE REZONING OF THE PROPERTY TO C-1 ON THE
OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND
EFFECTIVE DATE.
WHEREAS, the CMner of the property described below, Schrimsher Land
Fund 1986 - II, Ltd,; and Schrimsher Land Fund V, Ltd., has petitioned the
City of Winter Springs, Florida, to reclassify the land use of the property
to Camnercial and to rezone the property to C-1 Neighborhocxi Comnercial:
Lot 1 and that portion of Lot 2 lying West of the West
I ine of Section 5, Township 21 South, Range 31 East,
extended Northerly, all in Section 31, Township 20 South,
Range 31 East; and Lots 1, 2, 3, and 4 and that portion of
Lots 5 and 6 lying North of State Road 419, Section 6,
Township 21 South, Range 31 East; all of the foregoing
lots being in the Philip R. Yonge Grant, Plat Book 1,
Pages 36 and 38, Public Records of Seminole County,
Florida;
Lots 3, 4, 5 and 6, Block A, D.R. Mitchell Survey of the
Levy Grant, PIa t Book 1, Page 5, Public Records of
Seminole County, Florida; and
Beginning at the intersection of the South boundary of Lot
6, Block A of said D.R. Mitchell's Survey and the easterly
boundary line of the Levy Grant; thence run Northwesterly
along the south boundary line of said Lot 6 to the
Easterly right-of-way line of Brantley Avenue as shown on
the said D. R. Mitchell Survey; thence Southwesterly along
the easterly right-of~y of said Brantley Avenue to the
point of intersection of said easterly right-of~y line
wi th the north line of Tuscawilla as shown on the said
D. R. Mitchell SUrvey; thence run East along the North line
of Tuscawilla a distance of 450 feet more or less, to the
NE corner of said Tuscawilla; thence run S. along the
easterly boundary of said Tuscawilla to a point of
intersection with an easterly extension of the North
boundary line of Lots 17 and 20 of said Tuscawilla; thence
run East a distance of 169 feet more or less, to the
Wester I y right-of~y line of the Atlantic Coast Line
Railway; thence Southeasterly along the said westerly
railway right-of~y line a distance of 957.3 feet, more
or less, to a point which is 660 feet north of the north
boundary line of the subdivision of Gardena Farms
according to the plat thereof recorded in Plat Book 6,
Page 23, Seminole County Records; thence run South 85
degrees East, parallel to and 660 feet distant fran the
North boundary of said Gardena Farms and an Easterly
extension of said North Boundary, a distance of 1595.5
feet, more or less, to a point on the easterly boundary
line of the Levy Grant; thence run N. 5 degrees East along
the Easterly line of said Levy Grant to the point of
beginning; excepting therefran the right-of~y for the
Sanford-0viedo Road, the right-of~y for the Tuscawilla-
Gabriella Road and the right-of~y of the Atlantic Coast
Line Railroad as all of the same are now located across
said parcel, said lands being also described as Lot 7 and
a part of Lot 8, less that portion of said lot 8 lying
westerly of Tuscawilla-Gabriella Road, Block A, D.R.
Mi tchell 's SUrvey of the Levy Grant, Plat Book 1, Page 5,
Public Records of Seminole County, Florida, and
WHEREAS, a portion of the property has been reserved for inclusion
in the right-of-way of State Road 434 by the Florida Department of
Transportation Right-of-way Reservation Map filed September 29, 1988, Map
Book 1, Pages 71-79, Public Records of Seminole County, Florida; and
WHERE'AS, the City of Winter Springs, Florida, has considered the
assignment of the Conunercial land use classification for the said property
on the Land Use Map of the City in accordance with Florida Statute 163.3187
and has determined that the reclassification of the property on the Land Use
Map to Camnercial, excluding the reserved additional right-of-way for SR
434, which will ranain unchanged, is consistent with the Comprehensive Plan
of the City of Winter Springs, Florida; and
WHEREAS, the City Camnission has determined that the rezoning of
the reclassified property to C-1 Neighborhood Camnercial on the Official
Zoning Map is in the interest of the City of Winter Springs, Florida.
NCW THEREFORE, BE IT ORDAINED BY THE CIIT CCMY1ISSION OF
THE CIIT OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Canprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to reclassify the property described below to
Camnercial on the Adopted Land Use Map:
Lot 1 and that portion of Lot 2 lying West of the West
line of Section 5, Township 21 South, Range 31 East,
extended Northerly, all in Section 31, Township 20 South,
Range 31 East; and Lots 1, 2, 3, and 4 and that portion of
Lots 5 and 6 lying North of State Road 419, Section 6,
Township 21 South, Range 31 East; all of the foregoing
lots being in the Philip R. Yonge Grant, Plat Book 1,
Pages 36 and 38, Publ ic Records of Seminole County,
Florida;

SECTION II - 'The reclassified property is hereby rezoned to C-1
Neighborhood Camnercial and shall be so specified on the Official Zoning Map
of the City.
SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or stib-section or part of this Ordinance.
SECTION IV - All Ordinances or parts of Ordinances in conflict
here-Ii th are hereby repealed.
SECTION V - 'This Ordinance shall take effect immediately upon its
final passage and adoption.

Dear Ms. Koch:
This law firm represents Oleda Dyson Casscells, the owner of
a 50% undivided interest in certain lands City of Winter Springs
which essentially lie in the north east corner of the inter-
section of highway 434 (formally 419) and Tuscawilla road (as it
extends known as Brantley road). It has recently come to our
attention that the enclosed petition for change in land use plan
and zoning has been filed by Schrimsher Land Fund, 1986-2, Ltd. a
Florida Limited Partnership. Please be advised that this petition
has been filed wihtout our clients conscent, and, in fact, our
clilnet specifically objects to the request. Accordingly, we
request that the enclosed petition be denied.
Please advise us of any hear ings or meetings at which the
City Councilor any department of the city at which this matter

Dear Mr. Schrimsher:
I have reviewed your proposal for an interchange between the Seminole
County Expressway Authority's (SCEA) Eastern Beltway and Tuskawilla Road.
In my opinion, this proposal offers the Authority several benefits which
should be given strong consideration. Most importantly, these benefits,
described below, appear to offset the costs of constructing this
interchange.
First, and most importantly, there is substantial public "benefit to be
gained. By extending Tuskawilla Road across SR 434 to provide a direct
connection to the Expressway will result in increased ridership (which
translates to more toll revenue) and a much improved access to the
Expressway for trips originating along the booming Tuskawilla Road and
SR 434 travel corridors. In fact, the nearest location for these trips
to access the Expressway is either a few miles east on SR 434 or through
the middle of the Tuscawilla Development. The first of these
alternatives results in loss of toll-producing traffic to a two-lane
competing facility (SR 434) while the second encourages through-traffic
on a residential boulevard (Winter Springs Boulevard) which was never
intended as a through-route to an Expressway. By providing the better
solution of extending Tuskawilla Road to the Expressway, overall delay to
the motoring public would be decreased, toll revenues would be increased,
and the negative impacts of through-traffic in a neighborhood would be
virtually eliminated. Preliminary analyses conducted using Seminole
County's Impact Fee network indicate an increased daily traffic
assignment of 18% north of an extended Tuskawilla Road and a slight
decrease of 7% south of SR 434 for a net overall gain in traffic volumes.
(Note: The reduction between SR 434 and Red Bug Lake Road is due entirely
to Tuskawilla Road traffic which stays on Tuskawilla Road to access the
Expressway instead of cutting through the Tuscawilla Development.) This
scenario did not include the increased Expressway ridership due to your
project which would further enhance the revenue projections.

A second area that the proposal may benefit the Authority is through a
reduction in construction costs of the Expressway. The current alignment
of the Expressway requires two crossings of the Seaboard Coastline
Railroad track. If the alignment was shifted further north as per your
proposal, allowing sufficient spacing to extend Tuskawilla Road across
SR 434 to interchange with the Expressway, these two crossings would be
eliminated. The potential savings appear to more than offset the cost
required to shift the alignment and to add the ramps to the bridge
already planned over Brantley Avenue.
Through your proposal, the Authority benefits from the cost reductions,
but even more importantly, gains another ally to their cause, maintaining
the necessary momentum to complete the Expressway. The favorable press
coverage received by the group of land owners who proposed the Southern
Connector from the Bee Line to SR 535 in Orange County as a part of
OOCEA's system met with support all the way to the Governor's office.
This proposal is a similar cooperative venture that has the potential,
subject to design reviews, to benefit both the Expressway Authority and
the citizens of Seminole County.
In closing, I feel that the proposed interchange with the Expressway,
combined with extending Tuskawilla Road, deserves greater study given its
potential benefits. It would definitely be to the Authority's credit to
consider every possible advantage that can be gained through cooperative
analysis and negotiations.
