ORDINANCE NO. 445
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE CITY COMPREHENSIVE PLAN IN ACCORDANCE WITH FLORIDA
STATUE 163.3187; PROVIDING FOR THE RECLASSIFICATION OF
PROPERTY TO COMMERCIAL ON THE ADOPTED LAND USE MAP;
PROVIDING FOR THE REZONING OF THE PROPERTY TO C-1 ON THE
OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND
EFFECTIVE DATE.
WHEREAS, the owner of the property described below, Wendell E.
Spears, has petitioned the City of Winter Springs, Florida, to reclassify
the land use of the property to Commercial and to rezone the property to C-1
Neighborhood Commercial:
Lots 26 and 27 (Less road and less part of Lot 27 more
particularly described as: Beginning at intersection of West
line of Lot 27 and Southerly line of new State Road 434 right-
of -way , run South 7 degrees 3 minutes 15 seconds East 300 feet,
North 82 degrees 56 minutes 45 seconds East 299.81 feet, North
7 degrees 3 minutes 15 seconds West 388.6 feet, then
Southwesterly on road to beginning), Entzminger Farms Add. No.
2, Plat Book 5, Page 9, Public Records of Seminole County,
Florida; and
WHEREAS, the City of Winter Springs, Florida, has considered the
assignment of the Comnercial land use classification for the said property
on the Land Use Map of the City in accordance with Florida Statute 163.3187
and has determined that the reclassification of the property on the Land Use
Map to Commercial is consistent with the Comprehensive Plan of the City of
Winter Springs, Florida; and
WHEREAS, the City Comnission has determined that the rezoning of
the property to C-1 Neighborhood Commercial on the Official Zoning Map is in
the interest of the City of Winter Springs, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to reclassify the property described below to
Commercial on the Adopted Land Use Map:
Lots 26 and 27 (Less road and less part of Lot 27 more
particularly described as: Beginning at intersection of
West line of Lot 27 and Southerly line of new State Road
434 right-of-way, run South 7 degrees 3 minutes 15 seconds
East 300 feet, North 82 degrees 56 minutes 45 seconds East
299.81 feet, North 7 degrees 3 minutes 15 seconds West
388.6 feet, then Southwesterly on road to beginning),
Entzminger Farms Add. No.2, Plat Book 5, Page 9, Public
Records of Seminole County, Florida; and
SECTION II - The property is hereby rezoned to C-1
Neighborhood Commercial and shall be so specified on the Official Zoning Map
of the City.

SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or sub-section or part of this Ordinance.
SECTION IV - All Ordinances or parts of Ordinances in conflict
herewi th are hereby repealed.
SECTION V - This Ordinance shall take effect immediately upon its
final passage and adoption.
