HomeMy WebLinkAboutOrdinance 442 Fire Prevention/Protection ORDINANCE NO. 442 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING SECTION 6-39, CHAPTER 6 OF THE CODE OF ORDINANCES, ENTITLED "FIRE PREVENTION AND PROTECTION"; SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined it to be in the best interests of the safety, health, and welfare of the citizens of the City of Winter Springs to provide for the adoption of the Fire Prevention Codes, and WHEREAS, it is necessary to update these Codes from time to time. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I - That Section 6-39 of Chapter 6 of the Code of Ordinances of the City of Winter Springs, Florida, is hereby deleted in its entirety, and the following replaced therefore: SECTION 6-39; AUTOMATIC FIRE SPRINKLER SYSTEMS Automatic Fire Sprinkler Systems shall be required as follows: 1. Throughout all buildings used for commercial purposes, including but not limited to, offices, merchantile stores, restaurants, manufacturing, industrial or storage, if the total square footage is five thousand (5000) square feet or more regardless of type of construction. 2. Throughout all hotels, motels, condominiums, apartment buildings, or dormitories regardless of size or type of construction. 3. Throughout all hospitals, nursing homes, adult congregate living facilities, or other medical facilities regardless of size or type of construction. 4. Throughout all "Group H" (hazardous) occupancies, regardless of size or type of construction, except where the application of water might constitute a life hazard or increase the severity of the fire. 5. Throughout all educational facilities regardless of size or type of construction. 6. Automatic Fire Sprinkler Systems shall be installed to the specifications of NFPA 13, "Standard for the installation of sprinkler systems," 1984 edition or NFPA l3-D, "Standard for the installation of sprinkler systems in one and two family dwellings," 1984 edition. 7. All buildings equipped with Automatic Fire Sprinkler Systems, as required by SECTION 6-39, paragraphs 1 - 5, shall be required to have such systems monitored by a central station monitoring company, installed to the specifications of NFPA 71, "Standard for the installation, maintenance and use of central station signaling systems," 1984 edition. 8. All Automatic Fire Sprinkler Systems, as required in SECTION 6-39, paragraphs 1 - 5, shall be required to have such systems inspected, tested and maintained to the specifications of NFPA l3-A, "Standard for the inspection, maintenance and testing of sprinkler systems," 1987 edition. A copy of each inspection report shall be fur- nished to the fire department. 9. All Automatic Fire Sprinkler Systems shall be installed by a licensed fire protection systems contractor pursuant of Florida Statutes 633.521 and Florida State Fire Marshal Rule 4A-46. 10. Should an Automatic Fire Sprinkler System be required to be shut off for any reason, the fire department shall be notified when it is shut off and when it is returned to service. SECTION II - If any section or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or sub-section or part of this Ordinance. SECTION III - All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION IV - This Ordinance shall take effect immediately upon its passage and adoption.
