AMENDED ORDINANCE NO. 439
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH
FLORIDA STATUTE 163.3187; PROVIDING FOR THE
RECLASSIFICATION OF PROPERTY TO C(M\1ERCIAL ON THE ADOPTED
LAND USE MAP; PROVIDING FOR THE REZONING OF THE PROPERTY
TO C-1 ON THE OFFICIAL ZONING MAP; SEVERABILITY,
CONFLICTS, AND EFFECTIVE DATE.
WHEREAS, the CMl1er of the property described below, Schrimsher Land
Fund III, Ltd., has petitioned. the City of Winter Springs, Florida, to
reclassify the land use of the property to Conunercial and to rezone the
property to C-1 Neighborhood Conunercial:
The west 1,080 ft. of Lot 14 and the West 1,080 ft. of
that part of Lot 21 lying North of the Sanford-Oviedo
Road, Philip R. Yonge Grant, Plat Book 1, Pages 35-37,
Public Records of Seminole County; and
WHEREAS, a portion of the property has been reserved for inclusion
in the right-of-way of State Road No. 434 by the Florida Department of
Transportation Right-of-Way Reservation Map filed September 29, 1988, Map
Book 1, Pages 71-79, Public Records of Seminole County; and
WHEREAS, the City of Winter Springs, Florida, has considered the
assignment of the Conunercial land use classification for the said property on
the Land Use Map of the City in accordance with Florida Statute 163.3187 and
has determined. that the reclassification of the property on the Land Use Map
to Conunercial, excluding the reserved additional right-of-way for SR 434,
which will remain unchanged, is consistent with the Comprehensive Plan of the
City of Winter Springs, Florida; and
WHEREAS, the Ci ty Conunission has determined that the rezoning of
the reclassified property to C-1 Neighborhood Conunercial on the Official
Zoning Map is in the interest of the City of Winter Springs, Florida.
NCW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to reclassify the property described below to
Commercial on the Adopted Land Use Map:
The West 1,080 ft. of Lot 14 and the west 1,080 ft. of
that part of Lot 21 lying North of the Sanford-OViedo
Road, less that property duly reserved for right-of-way
by the Reservation Map cited hereinabove, Philip R. Yonge
Grant, Plat Book 1, Pages 35-37, Public Records of
Seminole County.
SECTION II - The reclassified property is hereby rezoned to C-1
Neighborhood Conunercial and shall be so specified on the Official Zoning Map
of the City.

SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or sub-section or part of this Ordinance.
SECTION IV - All Ordinances or parts of Ordinances in conflict
rewi th are hereby repealed.
SECTION V - This Ordinance shall take effect immediately upon its
final passage and adoption.
