HomeMy WebLinkAboutOrdinance 436 Amending Comprehensive PlanAMENDED ORDINANCE NO. 436 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH FLORIDA STATUTE 163.3187; PROVIDING FOR THE RECLASSIFICATION OF PROPERTY TO PLANNED UNIT DEVELOPMENT ON THE ADOPTED LAND USE MAP; PROVIDING FOR THE REZONING OF THE PROPERTY TO PUD ON THE OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. WHEREAS, the owner of the property described below, Dittmer Properties, Inc., has petitioned the City of Winter Springs, Florida, to reclassify the land use of the property to Planned Unit Developnent and to rezone the property to PUD: Lot 25, less the west 204.42 ft. of the South 341.94 ft. as measured along the west and South lines thereof, Entzminger Farms Add. No.3, Plat Book 6, Page 27, Public Records of Seminole County; and WHEREAS, the City of Winter Springs, Florida, has considered the assignment of the Planned Unit Developnent land use classification for the said property on the Land Use Map of the City in accordance with Florida Statute 163.3187 and has determined that the reclassification of the property on the Land Use Map to Planned Unit Developnent is consistent with the Comprehensive Plan of the City of Winter Springs, Florida; and WHEREAS, the City Commission has determined that the rezoning of the property to PUD on the Official Zoning Map, in order that it may be included within the boundaries of the adjacent PUD, is in the interest of the City of Winter Springs, Florida. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT: SECTION I - The Comprehensive Plan of the City of Winter Springs, Florida, is hereby amended to reclassify the property described below to Plarmed Unit Developnent on the Adopted Land Use Map: Lot 25, less the west 204.42 ft. of the South 341.94 ft. as measured along the west and South lines thereof, Entzminger Farms Add. No.3, Plat Book 6, Page 27, Public Records of Seminole County. SECTION II - The property is hereby rezoned to PUD and shall be so specified on the Official Zoning Map of the City. SECTION III - If any section or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or sub-section or part of this Ordinance.
