HomeMy WebLinkAboutOrdinance 423 Transportation Impact Fees ORDINANCE NO. 423 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA "OPTING OUT" OF SEMINOLE COUNTY'S TRANSPORTATION IMPACT FEE ORDINANCE NO. 87-04; RESTRICTING AGAINST COLLECTION OF COUNTY TRANSPORTATION OR ROAD IMPACT FEES WITHIN THE CITY; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida has determined it to be in the best interest of the citizens of the City of Winter Springs, Florida that the City of Winter Springs immediately "opt-out" of Seminole County's Transportation Impact Fee Ordinance No. 87-04; and, WHEREAS, the constitutional authority of the City of Winter Springs to "opt-out" of Seminole County's Transportation Impact Fee Ordinance 87-04 is derived from Article VIII, Section l(F) of the Florida Constitution; and, WHEREAS, Seminole County does not have authority to unilaterally impose County impact fees within the municipal limits of the City of Winter Springs, Florida. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AS FOLLOWS: SECTION I. "Opt-out" Provision. The City of Winter Springs, Florida "opts-out" of Seminole County's Transportation Impact Fee Ordinance No. 87-04. There shall not be imposed or collected any County transportation or road impact fees on any parcel of real property or any residential or commercial building within the municipal limits of the City of Winter Springs, FLorida. SECTION II. Codification. It is the intention of the City Commission of the City of Winter Springs, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of Ordinances of the City of Winter Springs, Florida; that the Sections of this Ordinance may be renumbered or relettered to accomplish such intention; that the word "Ordinance" may be changed to "Section", "Article", or other appropriate word. SECTION III. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION IV. Severability. If any Section or portion of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall notbe held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION V. Effective Date. This Ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 11th day of July, 1988 CITY OF WINTER SPRINGS LEANNE M.
