HomeMy WebLinkAboutOrdinance 418 AnnexationORDINANCE NO. 418 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA TO EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER DESCRIBED LANDS SITUATED AND BEING IN SEMINOLE COUNTY, FLORIDA, PURSUANT TO FLORIDA STATUTES 171 .044; PROVIDING DIRECTION TO THE CITY CLERK; SEVERABILITY; CONFLICTS; AND EFFECTIVE DATE. WHEREAS, Jay Gladwin, Trustee, Barry T. & Phyllis Kirby, Charles W. & Linda D. Clark, Robert H. & Annabelle Frilen Ricardo & Rosario M. Lezcano, Victor A. S, Verna Tarnowski, Estate of Charles S. Lieffring, Frank Wade, Estate of Withnell B. Leike, Carol B. Santos, Edward R. & Terry L. Hutto, Delphine Lane, Henry J. & Sandra G. Clark, Frederick H. Bokop Jr., Eugene L. & Jean E. Kronenberg, John W. & Elenore E. Cummiskey, Estate of Virgil W. Rees, Edward W. & Edythe Leonard, Charles E. & Madelyn Cummiskey, Harlan Brandner, William Schweiker, Estate of Albert W. & Adeline O. Ricker, and Richard M. Beary & Abbe L. Radke have petitioned the City Commission of the City of Winter Springs, Florida, to annex the property described as follows as the owners thereof: The West 1/2 of the Southwest 1/4 of Sec. 4, T. 21 S.; R. 31 E., Less Parcels 2-B and 2-U (More particularly described as Less the N 361.88 ft. of the E 303.20 ft. and Less; the S 242.80 ft. of th N 604.76 ft. of the E 677.34 ft.) and Less that Portion Lying North of S.R. 434, All in Seminole County, Florida. WHEREAS, the Charter of the City of Winter Springs provides for the annexation of property into the corporate limits when enacted by an ordinance of the City, and pursuant to a petition of the landowners; and WHEREAS, Florida Statute 171.044 of the General Laws of Florida, provides that a Municipal corporat:ion may annex property into its corporate limits, upon the voluntary petition of the owners, by passing and adopting a nonemergency ordinance to annex said property; and WHEREAS, the City Commission of the City of Winter Springs, Florida, is desirous of annexing and redefining the boundaries of the municipality to include the subject property pursuant to the authority contained in the City Charter of the City of Winter Springs, Florida, and Florida Statute 171.044, General Laws of Florida. NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: SECTION I: That the City of Winter Springs, Florida, does herewith and does hereby annex and redefine the boundary lines of the DAVID N. BERRIEN CLERK OF CIRUICT COURT SEMINOLE COUNTY, FL 510766 RECORDED & VERIFIED 1988 JUN 2 PM 4:03 OFFICIAL RECORDS BOOK 1963 PAGE 1660 SEMINOLE CO. FL. OFFICIAL RECORDS BOOK 1963 PAGE 1661 SEMINOLE CO. FL. municipality of the City of Winter Springs, Florida, by including those certain contiguous lands lying in Seminole County, Florida, and more particularly described as follows: The West 1/2 of the Southwest 1/4 of Sec. 4, T. 21 S., R. 31 E., Less Parcels 2-B and 2-U (More particularly described. as Less the N 361.88 ft. of the E 303.20 ft. and Less the S 242.80 ft. of the N 604.76 ft. of the E 677.34 ft. ) and Less that Portion Lying North of S .R. 434, All in Seminole County F.lor:ida. SECTION I I ; That the City of Winter Springs land use classification and zoning category of this property win be assigned in accordance with Florida Statute 163.3184. SECTION III: That upon passage and adoption of this ordinance the City Clerk is hereby directed to file a certified copy of this ordinance the Clerk of the Circuit Court in and for Seminole County, Florida, and to file a certified copy with the Department of State of the State of Florida. SECTION IV: That if any section or portion of a section or subsection of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or portion of a section or subsection or part of this ordinance. SECTION V: That all ordinances or parts of ordinances conflict herewith are hereby repealed. SECTION VI; That this ordinance shall take effect immediately upon its final passage and adoption.
