HomeMy WebLinkAboutOrdinance 411 Board of Trustees ORDINANCE NO. 411 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING SECTION 2-6(d) TO PROVIDE FOR BOARD OF TRUSTEES CONSISTING OF FIVE MEMBERS; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined that the Board of Trustees which administers the Pension Plan for the Employees of the City of Winter Springs, Florida, which presently consists of four members is inadequate. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY ORDAINS: SECTION I - That Section 2-6(d) of the Code of Ordinances of the City of Winter Springs, Florida, is hereby deleted in its entirety and the following replaced therefor: (d) There is hereby created and established a board of trustees consisting of five (5) members and each shall be appointed for a term of three (3) years. The successors of the original appointees shall likewise be appointed for terms of three (3) years by resolution of the city commission. Vacancies in the board shall be filled by the city commission for the un- expired term of such vacancies. The board of trustees herein appointed is hereby authorized to enter into the plan with the City of Winter Springs, Florida. The board of trustees shall administer the plan pursuant to the provisions contained therein. SECTION II - If any section or portion of a seciton or subsection of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of section or subsection or part of this ordinance. SECTION III - That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION IV - This ordinance shall take effect immediately upon its passage and adoption.
