ORNINANCE NO. 403
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH
FLORIDA STATUTE 163.3187; PROVIDING FOR THE RECLASSIFICATION
OF PROPERTY TO LIGHT INDUSTRIAL ON THE ADOPTED LAND
USE MAP; PROVIDING FOR THE REZONING OF THE PROPERTY TO
C-2 ON THE OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS,
AND EFFECTIVE DATE.
WHEREAS, the owner of the property described below,
Robert W. Baxley, has petitioned the City of Winter Springs, Florida, to
reclassify the land use of the property to Light Industrial and to rezone the
property to C-2 General Commercial and Industrial:
South 120.5 ft. of East 361.5 ft. of Lot 7, Block A,
Johnson's Poultry Farms, Plat Book 6, Page 8, Public
Records of Seminole County; and
WHEREAS, the City of Winter Springs, Florida, has considered the
assignment of the Light Industrial land use classification for the said
property on the Land Use Map of the City in accordance with Florida Statute
163.3187 and has determined that the reclassification of the property on the
Land Use Map to Light Industrial is consistent with the Comprehensive Plan of
the City of Winter Springs, Florida; and
WHEREAS, the City Commission has determined that the rezoning of the
property to C-2 General Commercial and Industrial on the Official Zoning Map is
in the interest of the City of Winter Springs, Florida.
NOW THEREFORE, BE IT RESOLVED BY THE CITY CO~ISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to reclassify the property described below to
Light Industrial on the Adopted Land Use Map:
South 120.5 ft. of East 361.5 ft. of Lot 7, Block A,
Johnson's Poultry Farms, Plat Book 6, Page 8, Public
Records of Seminole County.
SECTION II - The property is hereby rezoned to C-2 General Commercia
and Industrial and shall be so specified on the Official Zoning Map of the City.
SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or sub-section or part of this Ordinance.

SECTION IV - All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.

AMENDMENT 4
This amendment is to reclassify the remalnlng portion of the Baxley property
that was not amended previously. The Baxley annexation by Ordinance 334
totalled more than the 3 acres of commercial land allowed to be amended
under the small-scale procedures. Baxley opted to process only the portion
of his property covered by Ordinance 353 last year in order to proceed with
development at that time. The small-scale amendment regulations require
that one owner may not request amendment of property adjacent to property
reclassified under this option for a period of twelve months. That time has
now expired and it is proper to complete the amendment of the remaining
acre of Lot 7, Block A, Johnson's Poultry Farms to Light Industrial.
