HomeMy WebLinkAboutOrdinance 390 Accountant Selection ORDINANCE NO. 390 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, APPROVING A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF WINTER SPRINGS, FLORIDA PROVIDING THAT THE COMMISSION SHALL DESIGNATE AN ACCOUNTANT NO LATER THAN SIX MONTHS, INSTEAD OF THIRTY DAYS, AFTER THE BEGINNING OF A FISCAL YEAR; PROVIDING FOR A REFERENDUM ELECTION BY CITY ELECTORS TO APPROVE OR REJECT THE AMENDMENT TO THE CITY CHARTER; PROVIDING FOR SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, the Commission finds it better serves the needs of the city to allow the Commission to designate an accountant no later than six (6) months, instead of thirty (30) days after the beginning of a fiscal year; NOW, THEREFORE, be it enacted by the Mayor and Commissioners of the City of Winter Springs, Florida that: Section 1. The following proposed amendments to the Charter for the City of Winter Springs, Florida, is hereby approved and adopted by the Commission for placement on the ballot in the next general election: SECTION 4.12. INDEPENDENT AUDITS. The commission shall provide for an independent audit of all city accounts and may provide for such more frequent audits as it deems necessary. Such audits shall be made by a certified public accountant or firm of accountants who have no personal interest, direct or indirect in the fiscal affairs of the city government or any of its officers. The commission may, without requiring competitive bids, designate such accountant or firm annually or for a period not exceeding three (3) years provided that the designation for any particular fiscal year shall be made no later than thirty (30) six (6) months after the beginning of such fiscal year. If the state makes such an audit the commission may accept it as satisfying the requirement of this section. Section 2. All other provisions of the Charter of the City of Winter Springs, Florida shall remain in full force and effect. Section 3. The Mayor and City Commission hereby direct that the proposed amendments to the City Charter of Winter Springs, Florida, as set forth in Section I of this Ordinance, be placed on the ballot in the form of a single question, as set forth in Section 5 of this Ordinance, indicating the chief purpose of the proposed amendments, for approval or rejection by the City electors at the next general election held in the City. Section 4. Such referendum election shall be held in con- formance with the laws of the State of Florida and ordinances of the City of Winter Springs, Florida relating to the amendment of the City Charter. Section 5. The ballot to be used in the referendum election shall be substantially in the following form: PROPOSED CHARTER AMENDMENT REGARDING APPOINTMENT OF ACCOUNTANT Shall the proposed amendment to the Charter for the City of Winter Springs, Florida providing the Commission may designate an accountant within six months after the end of a fiscal year, approved by the Mayor and City Commissioners in Ordinance No. 390 on Aug. 10, 1987, be approved and adopted? Yes for approval: No for rejection: Section 6. Upon adoption of the proposed Charter amendments by a major i ty of the electors voting in a referendum election upon such amendments, the City Commission shall have the Charter, as amended, filed with the Secretary of State, at which time the amended Charter shall take effect. Section 7. The provisions of this Ordinance are severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held invalid or unconstitutional, the remaining sections, sentences, phrases or clauses of this Ordinance, shall remain valid and in full force and effect. Section 8. All Ordinances or parts of Ordinances in con- flict herewith be and the same are hereby repealed. Section 9.
