ORDINANCE NO,. 365
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE COMPREHENSIVE PLAN IN ACCORDANCE WITH
FLORIDA STATUTE 163.3187; PROVIDING FOR THE RE-
CLASSIFICATION OF PROPERTY TO MEDIUM DENSITY RESIDENTIAL
ON THE ADOPTED LAND USE MAP; PROVIDING FOR THE REZONING
OF THE PROPERTY TO R-T ON THE OFFICIAL ZONING MAP;
SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE.
WHEREAS, the owner of the property described below, Janet Gould, has
petitioned the City of Winter Springs, Florida, to be allowed to develop the
land in a manner which requires the land use of the property to be reclassified
to Medium Density Residential and the zoning to be changed to R-T:
Lot 26, Luttrell Park, according to the Plat thereof recorded
in Plat Book 11, Page 44, of the Public Records of Seminole
County; and
A portion of the unnumbered part of Block B, of D.R. Mitchell's
Survey the Levy Grant, recorded in Plat Book 1, Page 5, of the
Public Records of Seminole County, Florida,lying Southerly of
Lots 26 and 27, of said Block B, lying Westerly of Block A,
lying Easterly of Block D and lying Northerly of portion being
more particularly described as follows: Being at the Most
Southerly corner of Lot 26, Block B, said Plat of D.R. Mitchell's
Survey of the Levy Grant, thence N. 71 31'27;W., 81.53 feet
along the Southerly line of said Lot 26 to the Easterly Right-
of-Way line of platted road lying between Blocks Band D, of
said D.R. Mitchell's Survey of the Levy Grant, thence S.22'02'47:E.,
39.48 feet along said easterly Right-of-Way line to the Southerly
Right-of-Way line of the platted road lying South of and adjacent
to said Lot 26, thence S. 71'30'27"E., 300.90 feet along said
Southerly Roght-of-Way line to the Westerly Right-of-Way line
of State Road 419, thence S.51 17'18"W., 238.70 feet to the
Westerly line of said Block B, thence N.22'02'4J"W., 264.03 feet
along the Westerly line of said Block B to the Point of begining.
WHEREAS, the City of Winter Springs, Florida, has considered the
assignment of the Medium Density Residential land use classification for the
said property on the Land Use Map of the City in accordance with Florida
Statute 163.3187 and has determined that the reclassification of the property
on the Land Use Map to Medium Density Residential is consistent with the
Comprehensive Plan of the City of Winter Springs, Florida, and
WHEREAS, the City Commission has determined that the rezoning of
the property to R-T Mobile Home Park on the Official Zoning Map is in the
interest of the City of Winter Springs, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to reclassify the property described below to
Medium Density Residential on the Adopted Land Use Map:
Lot 26, Luttrell Park, according to the Plat thereof recorded
in Plat Book 11, Page 44, of the Public Records of Seminole
County; and

Lots 26 and 27, of said Block B, Lying Westerly of Block A,
lying Easterly of Block D and lying Northerly of portion being
more particularly described as follows: Being at the Most
Southerly corner of Lot 26, Glock B, said Plat of D.R. Mitchell's
Survey of the Levy Grant, thence N.71031'27:W., 81.53 feet
along the Southerly line of said Lot 26 to the Easterly Right-
of-Way line of platted road lying between Blocks Band D, of
said D.R. Mitchell's Survey of the Levy Granti thence S.22'02'47:E.,
39.48 feet along said easterly Right-of-way line to the Southerly
Right-of-way line of the platted road lying South of and adjacent
to said Lot 26, thence s.71'30'27"E., 300.90 feet along said
Southerly Right-of-Way line to the Westerly Right-of-Way line of
State Road 419, thence S.51 17'18"W., 238.70 feet to the
Westerly line of said Block B, thence N.22'02'47"W., 264.03 feet
along the Westerly line of said Block B to the Point of beginning.
SECTION II - The property is hereby rezoned to R-T Mobile Home Park
and shall be so specified on the Official Zoning Map of the City.
SECTION III - If any section or portion of this Ordinance proves to
be invalid, unlawful or unconstitutional, it shallnot be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or sub-section or part of this Ordinance.
SECTION IV - All Ordinances or parts of Ordinances in conflict here-
with are hereby repealed.
SECTION V - This Ordinance shall take effect immediately upon its
final passage and adoption.
