ORDINANCE 353
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING, THE COMPREHENSIVE, PLAN IN ACCORDANCE WITH
FLORIDA STATUTES 163.3187; PROVIDING FOR THE ADDITION
OF ANNEXED PROPERTY TO THE LAND USE MAP AT COMMERCIAL
AND LIGHT INDUSTRIAL CLASSIFICATIONS; PROVIDING FOR THE
ZONING CATEGORY C-l AND C-2 FOR THE PROPERTY ON THE
OFFICIAL ZONING MAP; SEVERABILITY, CONFLICTS, AND
EFFECTIVE DATE.
WHEREAS the City of Winter Springs has annexed the property
described below, upon petition of the owner, Robert W. Baxley:
Lots 1 and 2, Lew-Jim Subdivision, Plat Book 11,
Page 38; and the North 240 feet of the East 361.5
feet, Lot 7, Block A, Johnson's Poultry Farm, Plat
Book 6, Page 8, and
WHEREAS the owner of the property wishes to use the property in
a manner consistent with the zoning category C-l of the City of Winter Springs
for Lots 1 and 2, Lew-Jim Subdivision, an,<i the zoning category C-2 for the
portion of Lot 7, Johnson's Poultry Earm; and
WHEREAS the annexed property must carry the land use classificatio
Commercial to allow for said zoning catagory C-l and the land use classification
Light Industrial to allow for zoning category C-2; and
WHEREAS the City of Winter Springs, Florida, has considered the
assignment of the Commercial and Light Industrial land use classifications for
the said properties on the Land Use Map of the City in accordance with Florida
Statutes 163.3187 and has determined that the addition of the properties to the
Land Use Map as Commercial and Light Industrial, respectively, is consistent
with the Comprehensive Plan of the City of Winter Springs, Florida.
NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The Comprehensive Plan of the City of Winter Springs,
Florida, is hereby amended to add to the Land Use Map the property described
below and to assign to it the land use classification Commercial:
Lots 1 and 2, Lew-Jim Subdivision, Plat Book 11,
Page 38, Public Records of Seminole County, Florida.
SECTION II - The property is hereby zoned C-l Neighborhood
Commercial and shall be so specified on the Official Zoning Map of the City of
Winter Springs, Florida.
SECTION III - The Comprehensive Plan of the City of Winter Springs
Florida, is hereby amended to add to the Land Use Map the property described
below and to assign to it the land use classification Light Industrial:
The North 240 feet of the East 361.5 feet of Lot 7,
Block A, Johnson's Poultry Farm, Plat Book 6, Page 8.
SECTION IV - The property is hereby zoned C-2 General Commercial
. and Industrial and shall be so specified on the Official Zoning Map of the
City of Winter Springs, Florida.
SECTION V - If any section or portion af this Ordinance proves
,to be invalid, unlawful or unconstitutional, it shall not be held to invalidate
,or impair the validity, force or effect of any other section or portion of a
section or sub-section or part of this Ordinance.
SECTION VI - All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
SECTION VII - This Ordinance shall take effect immediately upon
its final passage and adoption.
